- <br /> CITY OF LOUISVILLE <br /> BOARD OF ADJUSTMENT <br /> STAFF REPORT <br /> AUGUST 15, 2001 <br /> CASE: BOA #01-024 <br /> APPLICANT: Pete and Heather Withnell, 1495 Adams Place, Louisville, CO 80027 <br /> OWNER: Same <br /> LOCATION: Lot 20 Block 6 Parkwood Subdivision amended Filing #2 <br /> ZONING: RM - Residential Medium Density <br /> REQUEST: Approval of a variance to allow for the construction of a gazebo on the west <br /> side of the parcel (side yard), that would be located within the 25-foot <br /> minimum side yard setback requirement from a street for all uses bordering <br /> a street <br /> DEVELOPMENT REQUIREMENTS: (Per RM - Residential Medium Density Zoning): <br /> Setbacks: Required Proposed <br /> Front (For Principal Uses) 25 feet (existing) <br /> Rear (For Principal Uses) 25 feet . <br /> Side (For Principal Uses) 7 feet <br /> Rear - <br /> (For Accessory Structures) 10 feet 14 feet <br /> Side Yard(from a street) 25 feet 7 feet <br /> BACKGROUND: <br /> The parcel under review is a developed single-family lot in the Parkwood Subdivision Filing#2. <br /> The Parkwood Subdivision#2 was platted in December, 1976. There is no PUD overlay for the <br /> subdivision, therefore the standard RM zoning setbacks apply. <br /> In the Board's review, it will see Lot 20 is an oddly shaped, corner parcel that actually fronts <br /> along a street on two sides; to the east Adams Place, to the north Harper Street. Since the <br /> property "fronts" a street on two sides, it was determined that the actual "front" of the property is <br /> along the east side, on Adams Place. The side yard was then determined to be along Harper <br /> Street. The setback requirements for any use bordering a street is 25 feet from the property line <br /> 1 <br />
