-
CITY OF LOUISVILLE
BOARD OF ADJUSTMENT
STAFF REPORT
AUGUST 15, 2001
CASE: BOA #01-024
APPLICANT: Pete and Heather Withnell, 1495 Adams Place, Louisville, CO 80027
OWNER: Same
LOCATION: Lot 20 Block 6 Parkwood Subdivision amended Filing #2
ZONING: RM - Residential Medium Density
REQUEST: Approval of a variance to allow for the construction of a gazebo on the west
side of the parcel (side yard), that would be located within the 25-foot
minimum side yard setback requirement from a street for all uses bordering
a street
DEVELOPMENT REQUIREMENTS: (Per RM - Residential Medium Density Zoning):
Setbacks: Required Proposed
Front (For Principal Uses) 25 feet (existing)
Rear (For Principal Uses) 25 feet .
Side (For Principal Uses) 7 feet
Rear -
(For Accessory Structures) 10 feet 14 feet
Side Yard(from a street) 25 feet 7 feet
BACKGROUND:
The parcel under review is a developed single-family lot in the Parkwood Subdivision Filing#2.
The Parkwood Subdivision#2 was platted in December, 1976. There is no PUD overlay for the
subdivision, therefore the standard RM zoning setbacks apply.
In the Board's review, it will see Lot 20 is an oddly shaped, corner parcel that actually fronts
along a street on two sides; to the east Adams Place, to the north Harper Street. Since the
property "fronts" a street on two sides, it was determined that the actual "front" of the property is
along the east side, on Adams Place. The side yard was then determined to be along Harper
Street. The setback requirements for any use bordering a street is 25 feet from the property line
1
