They want the yard fenced and they have <br />done that improvement. The rock landscaping is everything outside of the fence. Everything <br />inside the fence is their backyard. They want to try and enjoy main floor living. The uniqueness <br />of this lot is the first thing. <br />The other issue is the garden level design. Because of this design, there is no way to get main <br />floor outdoor living other than at this deck height. The 30" rule is a big thing, but for these <br />applicants to walk out of their basement, there is no way to design this deck any lower. The <br />applicants have done extensive improvements on the home. <br />The requested expansion is very small when considering the size of the lot. The existing deck is <br />about to fall down and they have drainage issues. In its current design, you cannot put chairs in <br />certain areas because it is a walkway. We are not impeding anyone's views. <br />The applicants have talked to all of their neighbors and none disagree with it. TOA has <br />approved it. I drove around the neighborhood and found one other garden level, but the lot was <br />a completely different shape. The house sits uniquely on the lot. We actually have 200' of <br />sidewalk from one end to the other end. Along the 200', we have a 25' setback. A very <br />significant portion of the property cannot be used for anything other than installing a fence. <br />Hashman shows where the fence is located. Adams says we did not install just the fence, but <br />landscaped in front of it. We have planted trees and you can hardly see the fence. It blocks off <br />the view of the existing deck, and within two years, you won't see the deck. <br />There are four primary neighbors. There is one directly behind us. They have a large deck <br />below 30" and their coverage is probably more than ours. Because of where their house is <br />situated, they don't have to bring it up 7' as we do. We have talked to them and they have no <br />issue with our deck. We brought over the design and sketches. The other three houses are on <br />the other side of the street. We met with each of them and none of them have any issues. There <br />are only two houses that would be impacted. With the changes we have made, there is less <br />visual view of the deck because of the trees we've planted. <br />Commission Questions of Applicant: <br />Stuart asks about the HOA approval because the packet does not contain anything. Is there <br />evidence of the approval? <br />Hashman says I can pull up the approval in an email. <br />DeJong asks what the actual construction of the deck will be. Will it be wood planks with <br />separation between the planks? <br />Hashman says it will be galvanized steel framing underneath with fascia covering it and <br />blending with the house. The deck itself will be composite decking. There will be 1/8" separation <br />between the boards. <br />Stuart says to Adams, there is one house directly behind your house that has a clear view of <br />the full deck. Are they okay with it? <br />
