RESOLUTION NO. 78 <br />SERIES 2016 <br />A RESOLUTION APPROVING A FINAL PLAT AND FINAL PLANNED UNIT <br />DEVELOPMENT (PUD) TO CONSTRUCT A MULTI -USE DEVELOPMENT <br />CONSISTING OF 38 DWELLING UNITS AND 40,000 SQUARE FEET OF <br />COMMERCIAL SPACE AT BLOCK 11, NORTH END PHASE II <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application requesting approval of a Final Plat and Final Planned Unit Development <br />(PUD) to construct a multi -use development consisting of 38 residential units and <br />40,000 square feet of commercial space at Block 11, North End Phase II; and <br />WHEREAS, the City Staff has reviewed the information submitted and found that <br />the application complies with the Louisville zoning and subdivision regulations and other <br />applicable sections of the Louisville Municipal Code; and; <br />WHEREAS, after a duly noticed public hearing on November 10, 2016, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated November 10, 2016, the Planning <br />Commission recommended approval of the plat and PUD to City Council, with two <br />conditions; and <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission and finds that said plat and PUD should <br />be approved, subject to conditions. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve a Final Plat and Final Planned Unit <br />Development (PUD) to construct a multi -use development consisting of 38 residential <br />units and 40,000 square feet of commercial space at Block 11, North End Phase II <br />subject to the following conditions: <br />1. Prior to the recordation of the PUD, the PUD plans shall be revised to include the <br />following notes to the Phasing Plan: <br />a. In Phase I, no residential building permits shall be issued until completion <br />and final inspection approval of a foundation for Building 6. <br />b. In Phase II, no residential building permits shall be issued until completion <br />and final inspection approval of a foundation for Building 5. <br />c. In Phase III, no residential building permits shall be issued until completion <br />and final inspection approval of a foundation for Building 4. <br />d. A residential building permit in Phase II shall not be issued until after a <br />Certificate of Occupancy has been issued for Building 6. <br />2.
