NOTES AND USE CONDITIONS <br />1. This Special Review Use (SRU) approval fully and completely supercedes the previous SRU approval and <br />directly related entitlements. <br />2. Parking lot shall be striped per the plan. <br />3. Any rental or rental franchise business requires a separate SRU review and approval. <br />4. Retail and wholesale auto sales are limited to passenger vehicles and passenger pickups in Zone "A <br />Other vehicles associated with trade-ins and consignments, including but not limited to recreational <br />vehicles, boats, commercial trucks and similar type vehicles not for typical passenger use, shall not be <br />stored in Zone "A" for more than 72 hours. Zone "B" may include those uses permitted in Zone "A" and <br />also include vehicles customarily associated with retail and wholesale auto sales such as trailers, tow <br />trucks and other equipment. <br />5. Site lighting shall be of a cut-off and downcast design subject to Staff review and approval. Lighting is <br />limited to not more than two luminaires, not to exceed 175 -watt metal halide or 16 -feet in height. <br />6. Banners, pennants, string lighting, or any other thing which by reason of its form, color, wording, <br />symbol, design, illumination, motion, or otherwise, attracts or is designed to attract attention to the site <br />or is used as a means of identification, advertisement or announcement other than approved business <br />identification signs are prohibited. Vehicle descriptions, pricing inforrnation and dealer nametags are <br />permissible on the retail vehicles only. Temporary signs and advertising shall comply with Louisville <br />Municipal Code as amended from time to time. <br />7. These two business identification signs are regulated by Louisville Municipal Code and applicable design <br />standards and guidelines as may be amended fromtime to time. <br />8. These SRU uses shall not rely on parking in the Pine Street right-of-way (no on -street parking). <br />9. This SRU approval runs with the owner herein only and shall not be deemed to effect changes to the <br />tenant, which is presently designated as "Pollard" on this plan, insofar as there remains compliance <br />with the terms of this SRU approval. At such time the owner ceases to operate the approved use, this <br />SRU approval shall terminate. <br />10, Based on an I_LC. gated L7 duly aggg; an encroachment into the Pine Street11.0.W. may exist. This <br />SRU approval shall not be deemed to authorize any such encroachment, and the City reserves all rights <br />to require at any time that any encroachments into the Pine Street right-of-way be eliminated by the <br />property owner at Its sole expense. Revocable permission to maintain an encroachment may only be <br />obtained through a separate, written Revocable License Agreement with the City. <br />11.
