ORDINANCE NO. 1343 SERIES 2000 AN ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS FOR THE ACQUISITION OF VACANT REAL ESTATE WHEREAS, the City of Louisville and Doris J. Moses have entered into a Purchase Contract for the City's acquisition of a parcel of land of approximately 0.58 acres located at 520 South Boulder Road and more particularly described on Exhibit A, attached hereto and incorporated herein by this reference (hereinafter "the Property"); and WHEREAS, the City intends to acquire the Property for a future site for the Louisville Housing Authority; and WHEREAS, the City is authorized to acquire the Property for such purpose pursuant to state law, including but not limited to C.R.S. section 29-4-106: and WHEREAS, the City Council deems the acquisition of the Property to be necessary; and WHEREAS, the Purchase Contract provides that the City shall pay the owner of the Property a total purchase price of One Hundred and Fifty-Four Thousand Dollars ($154,000.00) for the Property; and WHEREAS, the City Council by this ordinance desires to identify the source of funding for such purchase and otherwise comply with Colorado Revised Statutes regarding the acquisition of the Property, including but not limited to C.R.S. section 29-4-121. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Unless other funds become available for use by the City as determined by the City Council, moneys from the City Capital Fund shall be used to pay the purchase price of the Property, which Property is described on Exhibit A and in Purchase Contract therefor. Section 2. City payment for the Property shall be made in cash, certified funds or City warrant, subject to the Purchase Contract and to any necessary budgetary transfers or supplementary budgets and appropriations in accordance with State law. Section 3. Nothing in this Ordinance is intended to nor should be construed to create any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever.
