ORDINANCE NO. 1343 <br />SERIES 2000 <br />AN ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS FOR THE <br />ACQUISITION OF VACANT REAL ESTATE <br />WHEREAS, the City of Louisville and Doris J. Moses have entered into a Purchase <br />Contract for the City's acquisition of a parcel of land of approximately 0.58 acres located at 520 <br />South Boulder Road and more particularly described on Exhibit A, attached hereto and <br />incorporated herein by this reference (hereinafter "the Property"); and <br />WHEREAS, the City intends to acquire the Property for a future site for the Louisville <br />Housing Authority; and <br />WHEREAS, the City is authorized to acquire the Property for such purpose pursuant to <br />state law, including but not limited to C.R.S. section 29-4-106: and <br />WHEREAS, the City Council deems the acquisition of the Property to be necessary; and <br />WHEREAS, the Purchase Contract provides that the City shall pay the owner of the <br />Property a total purchase price of One Hundred and Fifty-Four Thousand Dollars ($154,000.00) for <br />the Property; and <br />WHEREAS, the City Council by this ordinance desires to identify the source of funding for <br />such purchase and otherwise comply with Colorado Revised Statutes regarding the acquisition of <br />the Property, including but not limited to C.R.S. section 29-4-121. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the City Capital Fund shall be used to pay the purchase price of the <br />Property, which Property is described on Exhibit A and in Purchase Contract therefor. <br />Section 2. City payment for the Property shall be made in cash, certified funds or City <br />warrant, subject to the Purchase Contract and to any necessary budgetary transfers or supplementary <br />budgets and appropriations in accordance with State law. <br />Section 3. Nothing in this Ordinance is intended to nor should be construed to create <br />any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. <br />Section 4.The property is not being acquired, and will not be held or used, for any park or <br />governmental purpose of the City.
