1995.

Mayer accepted the friendly amendment. Seconder, Lathrop, accepted
also.

Roll call was taken. Motion passed by a 5-0 vote.

APPOINTMENT TO THE ARTS & HUMANITIES COMMISSION - 1 VACANCY -
APPOINTED BY MAYOR - MARILYN REST (FILL VACANCY - TERM 1/95)

Davidson appointed Marilyn Rest to fill the vacancy for the term
that expires January 1, 1995.

PRESENTATION - LOUISVILLE FIRE DISTRICT - DEVELOP SITE WEST OF
SUBSTATION TWO

Bruce Joss, 824 Pine Street, Attorney for Louisville Fire
Protection District, explained that they were asking for Council's
approval to go ahead with the project. They were concerned with
the "reverter clause" ("So long as said partial is used solely for
a fire station and emergency rescue purposes and as a training
facility for such purposes, and if not, reverting to Grantor, its
successors, and assigns). They wish to have shared quarters to be made available
for an ambulance service company.

Lathrop:

Could we correct the language of the
"reverter clause" with a correction
Deed?

Griffiths:

I would say that there is enough
flexibility in the words "emergency
rescue" to conclude that. If you
chose to do so, you could interpret
those to include an ambulance
service provided in conjunction with
a fire protection service. I am
assuming you would not suggest that
this area could ever be used solely
for ambulance services. Is that
correct?

Joss:

That's correct.

Griffiths:

To some extent, it's within your
discretion how you interpret the
words "emergency rescue".

Mayer:

I have a concern on the 4th of July,
the Fire District came in and
requested over $2,000.00 from the
