Code: The building code in effect at the time of the house construction would have been the <br />l955Uniform Building Codes (UBC)(attached). The minimum headroom cleararce in 1955 was <br />6'6^ Research shows the minimum requirement for stairway headroom clearance did not <br />increase to6'8^ until the early 90's and rernains that today. The City of Louisville is currently <br />urider the adopted 2012 lnternatiorial Residential Code (IRC). Ir your Appeal Application you <br />quoted R311.7.2 and R102.7 This requirement, R311.7.2 is for new construction and is more <br />restrictive than tbe requirement iri 1950 wben tbe horne was built. <br />Issue: The existing horne has a stairway leading to the basement. Attbe bottom ofthe <br />stairway is a structural existing steel girder witb a head cleararice height oF E (72"). The <br />applicant bas submitted a permit to remodel/finisb the basernent. The BuFldirig Official will not <br />approve ari existing 6 stairway head height. <br />Summary As stated in the home history portion of this report, the home at 1610 Circle Drive <br />was built in 1960. The miriimum building code stairway headroam clear.ance requirement in <br />1960 when the home was constructed was 6'6" (attached). That said, along with our records <br />showing no permits for the basement area, I will assume the 6' stairway headroom clearance <br />violation has always been there from the beginning ofthe homes existence. |nyour <br />application, you have provided (1)section and (1) suhsection to the (IRC)International <br />Residential Code which] have addressed above. As for any IBC references in your Appeals <br />App|[catinn'thep|annaverereviewedandthepermitwasissuedumderthe|RC.|fvvevvereto <br />review and issue the permit underthe adopted IBC, based ori IBC 903.Z.8you would be <br />required to provide a sprinkler system in both the proposed basement finish project and the <br />existing house and there are no exceptions. It is for that reason we review one and two family <br />residential applicatioris urrderthe IRC as there is ari exceptiori to tlie residential requirement <br />for existing structures (R3I3.2). <br />Final Decision: The minimum allowable stairway headroom clearance allowed for this existing <br />structure is 6'6" based nn20lZIRC RI027/l02II(shown be|ow)and the l955U0C3D05(U <br />(attached) <br />
