ORDINANCE NO. 1734 <br />SERIES 2017 <br />AN ORDINANCE APPROVING THE VACATION OF A 10 -FOOT WIDE DRAINAGE <br />EASEMENT ON LOTS 1, 16, AND 17, BLOCK 2, COLORADO TECHNOLOGICAL <br />CENTER, FIRST FILING <br />WHEREAS, by the plat of Colorado Technological Center, First Filing, recorded in the <br />Office of the Boulder County Clerk and Recorder on September 27, 1979 at Reception No. 361999, <br />there was dedicated to the City a 10 -foot drainage easement on Lots 1, 16 and 17 in the location <br />further described in Exhibit A attached hereto and incorporated herein by this reference ("the 10 - <br />foot Easement"); and <br />WHEREAS, the Innovative Openings Final Planned Unit Development ("the PUD"), <br />approved by City Council on December 20, 2016 under Resolution No. 70, Series 2016, includes <br />a condition that the property owner, PF Investments, LLC, vacate the 10 -foot drainage easement <br />prior to the issuance of a building permit; and <br />WHEREAS, the City Council fmds and determines that the 10 -foot Easement for which <br />vacation is requested is not and will not be needed for any public purposes and will not be needed <br />for any City utility purposes; and <br />WHEREAS, the City Council fmds and determines that the 10 -foot Easement for which <br />vacation is requested is not being used or held for park purposes or for any other governmental <br />purposes; and <br />WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the 10 -foot Easement for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, E, COLORADO: <br />Section 1. The City hereby approves the vacation of that certain 10 -foot wide drainage <br />easement located on Lots 1, 16 and 17, Block 2, Colorado Technological Center, First Filing, which <br />easement herein vacated is in the location further described in Exhibit A attached hereto and <br />incorporated herein by this reference ("the 10 -foot Easement"). <br />Section 2. No other easements for public utilities per the plat of Colorado <br />Technological Center, First Filing shall be deemed altered or amended by virtue of this ordinance. <br />Section 3. All other ordinances or portions thereof inconsistent or in conflict with this <br />ordinance or any portion hereof are repealed to the extent of such inconsistency or conflict. <br />Section 4. The Mayor and City Manager, or either of them, is authorized to execute <br />Ordinance No, 1734, Series 2017 <br />Page 1 of 8 <br />
