<br />CONDITIONS
<br />1. That a standard covenant agreement holding lots
<br />15 and 16 as a single parcel is recorded with
<br />Boulder County at or prior to recording of the final
<br />PUD plans;
<br />2. That a shared access agreement/easement for
<br />Lots 15, 16 and 17 shall be recorded with the Clerk
<br />and Recorder prior to recording of the final PUD;
<br />3. The additional access and utility easment area
<br />of 7,962 square feet on Lot 15 shall be
<br />dedicated as a public access utility easement at
<br />or prior to recording of this final PUD, without
<br />requirement for compensation from either the
<br />City or the benefitted property owner, provided
<br />that the Owner, it's successors and assigns shall
<br />receive 7,962 square feet of credit toward future
<br />public use dedications (as required by Section
<br />16.16.060 of the LMC) on other parcel(s)
<br />selected by Colorado Tech Land Company LLC, its
<br />designees, succesors and assigns within the
<br />Colorado Technological Center, provided, however,
<br />that in no event shall the credit be applied in a
<br />situation where the credit would exceed 50% of
<br />the total required public use dedication for said
<br />parcel, unless approved otherwise by Council.
<br />4. That it shall be noted on the grading and
<br />drainage plan that maximum slopes ad;scent to all
<br />retaining walls shall be 3:1 and that all walls shall
<br />be designed and certified by a structural engineer.
<br />5. Lot 15 and 16 shall be held as a single parcel
<br />of contiguous land and deemed a single lot for
<br />the purposes of building and development
<br />pursuant to the zoning ordinance of the city of
<br />louisville and the minimum lot area applicable to
<br />the combined lot area of lot 15 and 16 which
<br />shall be required in order to obtain a building
<br />permit for the purpose of construction or
<br />development on lot 15 and 16 shall be the
<br />combined lot area of lot 15 and 16.
