<br />5. Sidewalk improvements shall be installed at the expense of the property
<br />owner pursuant to a master sidewalk plan for th CTC approved by the City.
<br />6. Compliance with the CTC Sidewalk Plan may require a partial redesign of
<br />the existing stormwater detention areas.
<br />7. Existing fire hydrants shall be adjusted vertically and/or horizontally to
<br />City Standards if it would interfere with the placement of a future sidewalk.
<br />8. Deciduous trees shall not be planted within five feet or coniferous trees

<br />9. Prior to construction within public right of way, the owners shall submit

<br />10. Square footage represented on this submittal used to determine parking
<br />reqiurements is based upon gross figures. Final parking requirements will be
<br />based upon gross figures less space allocated for stairwells, elevator shafts,
<br />hallways, ornamental balconies, space occupied by heating, air conditioning or
<br />other utility equipment, space devoted exclusively to storage (excluding
<br />warehouse) and space devoted to off-street parking or loading. As per
<br />section 17.20.010 of the City of Louisville Zoning Ordinance effective 1996.
<br />11. Developments in the CTC are currrently on a sole source supply line for
<br />water. Those locating to the Park are subject to interruption of service in
<br />case of emergencies or unavoidable maintenance activities that affect the sole
<br />source may be inadequate to meet during times of peak usage within the CTC.
<br />12. The property owner shall replace all existing curb, gutter, and pavement
<br />that has settled or is otherwise damaged, adjacent to the development.
<br />13. Curb, gutter, and pavement that needs to be removed and replacedwill be
<br />marked by a City Inspector prior to beginning public improvements.
<br />14. Building permits shall not be issued for office occupancy irr excess of
<br />square footage listed in the required parking calculations.
<br />15. No Certificates of Occupancy will be isued until construction acceptance is
<br />granted for the public improvement.
<br />16. This approval supercedes the existing approved PUD as it relates to the
<br />total build out floor area.
<br />NOTICE: DUTY OF COOPERATION
<br />Release of these plans contemplates
<br />further cooperation among the owner, his
<br />contractor and the architect. Design and
<br />construction are complex. Although the
<br />architect and his consultants have
<br />performed their services with due care and
<br />diligence, they cannot guarantee perfection.
<br />Communication is imperfect, and every
<br />contingency cannot be anticipated. Any
<br />ambiguity or discrepancy discovered by the
<br />use of these plans shall be reported
<br />immediately to the architect. Failure to
<br />notify the architect compounds
<br />misunderstanding and increases
<br />construction costs. A failure to cooperate
<br />by a simple notice to the architect shall
<br />relieve the architect from responsibility for
<br />all consequences. Changes made from the
<br />plans without consent of the architect are
<br />unauthorized, and shall relieve the architect
<br />of responsibility for all consequences
<br />arriving out of such changes.
