<br />HORIZONTAL PUBLIC IMPROVEMENTS FOR THE PROPERTY WILL BE CONSTRUCTED TO
<br />SERVICE THE PROJECT AND MAY BE PHASED. THIS PLAN IS NOT MEANT TO DICTATE THE
<br />PHASING ASSOCIATED WITH THIS PROJECT BEYOND WHAT IS STATED IN THESE NOTES. THE
<br />HORIZONTAL PUBLIC IMPROVEMENTS ARE IDENTIFIED IN THE SUBSEQUENT TEXT AND SHALL
<br />ALLOW FOR THE GENERAL PROJECT NOTES, AS FOLLOWS:
<br />1. RETAINING WALLS MAY BE REQUIRED FOR THE DEVELOPMENT OF THE PARCEL TO THE
<br />STANDARDS AND REQUIREMENTS OF THE CITY, DEVELOPER AND MARKET NEEDS.
<br />WALLS OVER 3' WILL BE MINIMIZED TO THE EXTENT PRACTICAL AND IF FEASIBLE,
<br />WALLS OVER 3' SHALL BE TIERED. WALL COLORS AND MATERIALS SHALL MATCH OR
<br />BE COMPLEMENTARY THROUGHOUT THE DELO DEVELOPMENT.
<br />2. NO OFF-SITE IMPROVEMENTS ARE REQUIRED OTHER THAN WHAT IS DEPICTED WITH
<br />THIS PUD.
<br />3. AN OFF-SITE DRAINAGE FACILITY TO SERVICE THE CORE PROJECT AREA IS REQUIRED
<br />FOR DETENTION AND WATER QUALITY. THE REQUIREMENTS OF THAT FACILITY AND
<br />THE ASSOCIATED IMPACTS TO THIS PROJECT SHALL BE CONSISTENT WITH THE
<br />FINALIZED SUBDIVISION IMPROVEMENT AGREEMENT. THE POND MUST BE
<br />OPERATIONAL PRIOR TO CONSTRUCTION ACCEPTANCE.
<br />4. PHASING (AND SUBPHASING)OF THE DEVELOPMENT AREAS MAY OCCUR IN ANY
<br />ORDER AND IS NOT LIMITED EXCEPT AS REQUIRED TO PROVIDE LOOPED WATER
<br />SERVICE(S), SANITARY SERVICE, TWO POINTS OF EMERGENCY ACCESS AND THAT NO
<br />"DEAD END" LONGER THAN 500' WITHOUT A SECONDARY EMERGENCY ACCESS,
<br />SHALL OCCUR.
<br />5. REGIONAL HORIZONTAL PUBLIC IMPROVEMENTS ARE INFRASTRUCTURE THAT
<br />PROVIDES REGIONAL AND REDEVELOPMENT BENEFIT AND SHALL BE FUNDED BY THE
<br />CITY OF LOUISVILLE, THE URBAN RENEWAL AUTHORITY PER THE ADOPTED
<br />AGREEMENT BY THE CITY OF LOUISVILLE OR BOND FUNDING, AS NEGOTIATED WITH
<br />ALL PARTIES. THE IDENTIFIED INFRASTRUCTURE IS ANTICIPATED TO BE CONSTRUCTED
<br />PRIOR TO OR CONCURRENT WITH THE SECOND PHASE OF THE PROJECT; HOWEVER,
<br />SUB -PHASING MAY OCCUR SO LONG AS EMERGENCY AND UTILITY ACCESS IS
<br />MAINTAINED THROUGH EACH PHASE. STREET CROSS SECTIONS AND ANTICIPATED
<br />IMPROVEMENTS ARE AGREED TO AND AVAILABLE FOR REVIEW WITHIN THIS

<br />RETAINING WALLS, TRANSITIONAL GRADING AND DRAINAGE CONNECTIONS AND MAY BE INCLUDED WITHIN ALL PHASES
<br />OF THE DELO DEVELOPMENT. THE DEVELOPER WILL REIMBURSE THE CITY OF ANY DELO SPECIFIC FEES ASSOCIATED WITH THE
<br />BNSF PERMITTING. ALL IMPROVEMENTS WILL BE BASED OFF THE FINAL PUD AND DETAILED WITHIN THE APPROVED
<br />CONSTRUCTION DOCUMENTS.
<br />4. PRIVATE IMPROVEMENTS SHALL NOT BE INCLUDED WITHIN THE DELO SUBDIVISION AGREEMENT.
<br />5. THE DEVELOPMENT IS NOT RESPONSIBLE FOR ANY MINER'S FIELD IMPROVEMENTS.
<br />6. ALL IMPROVEMENTS DEPICTED HEREIN ARE SUBJECT TO FINAL AGREEMENT WITHIN PROJECTS SUBDIVISION AGREEMENT
<br />AND APPROVED CONSTRUCTION DOCUMENTS.
<br />7. THE CITY FUNDED IMPROVEMENTS (SUBJECT TO FUNDING BY THE CITY) LOCATED WITHIN THE BNSF RIGHT OF WAY OR
<br />HIGHWAY 42 RIGHT OF WAY AND THE ASSOCIATED REQUIRED PERMITTING SHALL NOT DELAY THE DELO PHASE 2 PROJECT.

<br />1. A TEMPORARY DETENTION AND WATER QUALITY FACILITY SHALL BE CONSTRUCTED ON-SITE TO SERVICE DELO IN THE EVENT
<br />THAT AN OFF-SITE FACILITY TO SERVICE THIS PHASE OF THE PROJECT ISN'T AVAILABLE. THE DESIGN AND SPECIFICS SHALL BE
<br />PRESENTED WITHIN THE SUBSEQUENT CONSTRUCTION DOCUMENTS.
<br />2. IN THE EVENT THAT AN OFF-SITE FACILITY TO SERVICE THIS PROJECT IS NOT AVAILABLE AT THE TIME OF THE DEVELOPMENT A
