He was <br />wondering what influence the Council had in upholding a decision <br />that was made earlier. <br /> <br />Paul Wood, City Planner, stated that Outlot I is a private outlot <br />that is deeded and maintained by the Homeowner's Association. He <br />stated that the direction for condition for approval of Exhibit A, <br />Resolution No. 43 was a requirement to provide a 30 ft. wide access <br />easement. Mr. Maurer informed Wood that the overlot grading on <br />Coal Creek Ranch Filing No. 4 had substantially changed the grade <br />of Outlot I. Wood referred it to the City Attorney's office. <br /> <br />Susan Griffiths, City Attorney, stated that it is apparent that the <br />access easement was included on the PUD at the request of Mr. <br />Maurer and is an accommodation to Mr. Maurer. She stated that at <br />the City Council meeting at which the PUD and Subdivision Plat were <br />approved, prior to the actual motion to approve the Plat and PUD, <br />Councilman Sisk made a statement, according to the minutes of the <br />meeting, speaking to Mr. Maurer, that if the PUD is approved, that <br />it becomes incumbent upon the two parties to work this out and that <br />the City of Louisville cannot be part of the agreement. She stated <br />that the access easement was a matter between Mr. Mauer and Coal <br />Creek Ranch and the City was willing to accommodate the inclusion <br />of the access easement on the Plat, but the actual implementation <br />of that was in the hands of those two parties. She stated that the <br />conditions had been met for Plat approval and the PUD had been <br />filed. She stated that if Mr. Mauer has a concern with respect to <br />the grade, his remedy would be to approach Coal Creek Ranch. She <br />wasn't sure what actions the City could or should appropriately <br />take to assist in the resolution of this other than urging the two <br />individuals to sit down and work this out. <br /> <br />Howard wondered of Public Works had any concerns about this grading <br />being changed from 7% to 23%, which eliminates the possibility of <br />using that as a driveway access. <br /> <br />Tom Phare, Director of Public Works, stated that they've taken the <br />position that the access issue is an issue between Maurer and Coal <br />Creek Ranch. Public Works didn't have any documents that provided <br />any restriction on grades or gave them any criteria as to what <br />should or shouldn't be approved by Coal~ Creek Ranch. Phare did <br />state that a 23% grade is not desirable and will present problems <br />for access, particularly during the winter months. Phare stated <br />that the City is required to enforce an access to County property. <br /> <br />Mayer wanted a report on Mr. Mauer's situation by next Council <br />meeting, if possible. <br /> <br />Davidson called for anyone else in the audience who wished to speak <br />on any item not on the Agenda. <br /> <br />NONE <br /> <br /> <br />
