THIS PHASING PLAN IS NOT MEANT TO DICTATE THE PHASING ASSOCIATED WITH THIS PROJECT BEYOND <br />WHAT IS STATED IN THESE NOTES. THE PUBLIC HORIZONTAL IMPROVEMENTS INCLUDE THE FOLLOWING: <br />1) WEST HECLA DRIVE FROM THE EXISTING NORTHERN TERMINUS AT PROPERTY LINE TO THE EASTERN <br />TERMINATION AS DEPICTED HEREIN AND IS REQURED WITH THE FIRST PHASE OF THE DEVELOPMENT. <br />2) THE SANITARY SEWER LOCATED WITHIN WEST HECLA DRIVE IS REQUIRED WITHIN PHASE 1. <br />3) THE WATER LINE LOCATED WITHIN WEST HECLA ROAD, SOUTH BOULDER ROAD AND THE CONNECTION <br />THEREOF. PHASES MUST HAVE TWO POINTS OF CONNECTION AND MAY ROUTE THROUGH THE PROPERTY TO <br />ALLOW FOR THE INDEPENDENT DEVELOPMENT OF PLANNING AREA 4A AND PLANNING AREA 4B, AND <br />SUB—PHASING, THEREOF. <br />4) THE ONSITE STORM SEWER REQUIRED TO SERVICE THE INDEPENDENT DEVELOPMENT OF PA 4A AND PA 4B <br />AND THE IDENTIFIED DETENTION AND WATER QUALITY POND. <br />5) PHASING OF THE RESIDENTIAL PORTIONS OF THE SITE MAY OCCUR IN ANY ORDER AND IS NOT LIMITED <br />EXCEPT AS REQUIRED TO PROVIDE A LOOPED WATER SERVICE, SANITARY SERVICE, TWO POINTS OF <br />EMERGENCY ACCESS AND THAT NO "DEAD END" LONGER THAN 500' WITHOUT A SECONDARY EMERGENCY <br />ACCESS. <br />6) OFF—S1TE REGIONAL IMPROVEMENTS INCLUDE EXTENSION OF THE WATER MAIN AND STORM SEWER SYSTEM <br />TO THE MOST RESONABLY DIRECT CONNECTION POINT WITHIN S. BOULDER ROAD. THE CITY OF LOUISVILLE <br />WILL PROVIDE ADEQUATE CAPACITY TO SERVICE THE DEMANDS ASSOCIATED WITH THIS FINAL DEVELOPMENT <br />PLAN. <br />7) PLANNING AREA 4A, PHASE 2, AND PLANNING AREA 4B, PHASE 1, MAY BE CONSTRUCTED INDEPENDENTLY <br />OR CONCURRENTLY. <br />8) RETAINING WALLS MAY BE REQUIRED TO ACCOMMODATE SITE GRADING AND SHALL BE ALLOWED. <br />9) IMPROVEMENTS TO THE DAVIDSON HIGHLINE AND GOODHUE IRRIGATION DITCHES MAY BE REQUIRED TO <br />IMPLEMENT THE SITE DEVELOPMENT. ALL IMPROVEMENTS TO THOSE DITCHES WILL BE COORDINATED AND <br />APPROVED BY THE RESPECTIVE DITCH COMPANIES. THE DAVIDSON HIGHLINE DITCH IMPROVEMENTS ARE <br />ASSOCIATED VVITH THE PUBLIC LAND DEDICATION AND CONSTRUCTION RESPONSIBILITY SHALL BE PER THE <br />SUBDIVISION AGREEMENT. IMPROVEMENTS AND/OR AGREEMENTS FOR THE DAVIDSON HIGHLINE DITCH, IF ANY, <br />WILL NOT IMPACT OR DELAY CONSTRUCTION OF ANY PORTION OF THE STEEL RANCH SOUTH DEVELOPMENT. <br />GOODHUE DITCH IMPROVEMENTS MAY BE REQUIRED TO FINALIZE DEVELOPMENT OF PA4B. THOSE <br />IMPROVEMENTS, MAY CONSIST OF PIPING, OPEN CHANNELS OR ABANDONMENT. THE FINAL IMPROVEMENTS <br />TO THE GOODHUE DITCH SHALL ONLY IMPACT THE PHASING OF THE PA4B DIRECTLY ADJACENT <br />IMPROVEMENTS. FURTHER, TEMPORARY PA4B SITE IMPROVEMENTS SHALL BE ALLOWED TO AVOID IMPROVING <br />THE DITCH, PROVIDED THAT LIFE SAFETY, TRAFFIC MOVEMENTS AND UTILITY SERVICES MEET MINIMUM <br />10) THE HORIZONTAL PUBLIC IMPROVEMENTS ASSOCIATED WITH STEEL STREET AND LUKE STREET AND THE <br />ASSOCIATED UTILITY INFRASTRUCTURE MAY BE PHASED IF PA4A AND PA4B ARE DEVELOPED INDEPENDENTLY. <br />IN THAT CASE, THE PORTION OF STEEL STREET AND LUKE STREET WITHIN THE ENTIRETY OF THE INITIAL <br />PLANNING AREA SHALL BE DEVELOPED. ADDITIONALLY, SHOULD THE INDEPENDENT DEVELOPMENT OF THE <br />PLANNING AREAS OCCUR, THE WATER MAIN SHALL BE LOOPED AND TWO POINTS OF EMERGENCY ACCESS <br />ARE REQUIRED. THE SECOND POINT OF EMERGENCY ACCESS CAN BE ACCOMPLISHED VIA TEMPORARY <br />CONNECTION AT A LOCATION TO BE MUTUALLY AGREED BY THE FIRE MARSHAL AND THE OVERALL <br />DEVELOPER AND MAY BE CONSTRUCTED WITH AN APPROVED TEMPORARY SURFACE. <br />11) THE TERMINATION OF STEEL STREET, MORE SPECIFICALLY DESCRIBED AS THE "TOMAHAWK" CUL—DE—SAC <br />AND THE IMPROVEMENTS WITHIN OUTLOT 1, SHALL FOLLOW THE CONSTRUCTION RESPONSIBILITIES OUTLINED <br />IN THE SUBDIVISION AGREEMENT AND MAY BE DEVELOPED AS A PORTION OF THE IMPROVEMENTS WITH <br />PA4A. AN AGREEMENT. HOWEVER, IN NO CASE SHALL THE CITY OF LOUISVILLE "TOMAHAWK" CUL—DE—SAC <br />OR OUTLOT 1 IMPROVEMENTS EFFECT OR DELAY THE PROJECT APPROVALS OR THE CONSTRUCTION AND <br />FUTURE ACCEPTANCE OF THE PA4A OR PA4B IMPROVEMENTS. <br />12) FUTURE MODIFICATIONS TO THE MEDIAN ON SOUTH BOULDER ROAD MAY BE REQUIRED BY THE FIRE <br />MARSHAL FOR EAST BOUND EMERGENCY ACCESS.
