RESOLUTION NO. 39 SERIES 2017 A RESOLUTION APPROVING A PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) AND PRELIMINARY SUBDIVISION PLAT FOR 42 RESIDENTIAL TOWNHOME LOTS AND COMMON AREAS ON 3.7 ACRES ZONED RM AND WITH DETENTION FACILITIES AND OTHER LANDSCAPE IMPROVEMENTS ON THE ADJACENT CITY -OWNED 1.44 ACRE PARCEL WEST OF HIGHWAY 42 AND NORTH OF LOCK STREET; LOT 2, CLEMENTINE SUBDIVISION AND LOTS 1A, 1B, AND 1C CLEMENTINE FILING NO. 2 WHEREAS, there has been submitted to the Louisville Planning Commission an application requesting approval of a Preliminary Planned Unit Development (PUD) and Preliminary Subdivision Plat for 42 residential townhome Tots and common areas on 3.7 acres zoned RM and with detention facilities and other landscape improvements on the adjacent City -owned 1.44 acre parcel west of Highway 42 and north of Lock St.; Lot 2, Clementine Subdivision and Lots 1 a, 1 b, and 1 c Clementine Filing No. 2; and WHEREAS, the City Staff has reviewed the information submitted and found that the application complies with the Louisville zoning and subdivision regulations and other applicable sections of the Louisville Municipal Code; and WHEREAS, after a duly noticed public hearing on June 8, 2017, where evidence and testimony were entered into the record, including the findings in the Louisville Planning Commission Staff Report dated June 8, 2017, the Planning Commission recommended approval of the PUD Amendment to City Council, with three conditions: 1. Prior to the City Council public hearing, the applicant shall submit a drainage report which analyzes regional detention on the City -owned property. 2. Prior to the City Council hearing, the, plans shall be revised to the satisfaction of the LFPD. 3. Prior to the City Council hearing, the plans shall be revised to the satisfaction of the Public Works Department. WHEREAS, City Council has reviewed the application, including the recommendation of the Planning Commission and finds that said PUD Amendment should be approved with no conditions. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, Colorado does hereby approve a Preliminary Planned Unit Development (PUD) and Preliminary Subdivision Plat for 42 residential townhome lots and common areas on 3.7 acres zoned RM and with detention facilities and other landscape improvements on the adjacent City -owned 1.44 acre parcel west of Highway 42 and north of Lock St.; Lot 2, Clementine Subdivision and Lots 1 a, 1 b, and 1 c Clementine Filing No. 2 Resolution No 39, Series 2017 Page 1 of 2
