Louisville City Council Meeting <br />March 2, 2004 <br />Page 5 of 10 <br /> <br />COUNCIL COMMENT <br /> <br />Mayor Sisk asked the applicant if he was in agreement with the conditions placed on the <br />subdivision replat. Boyer confirmed he was in agreement with the conditions. <br /> <br />Council member Marsella asked if the two homes share the same sewer tap. Principal <br />Planner Johnstone explained each home has separate water and sewer billings, and <br />separate water connections. They had separate sanitary sewer connections, however, one <br />has been abandoned, and is tied into the connection at 533 Lincoln Avenue. The <br />applicant understands and agrees to reinstate both sewer connections. <br /> <br />MOTION: Council member Clabots moved to approve Resolution No. 13, Series 2004, <br />seconded by Council member Levihn. All in favor. <br /> <br />DISCUSSION/DIRECTION - DAVID WALDMAN REQUEST TO AMEND 1986 <br /> FABER ANNEXATION AGREEMENT <br /> <br />Mayor Sisk asked Council members to disclose any previous discussions or meetings <br />with Mr. David Waldman. The Mayor and all members of Council reported having <br />spoken to Mr. Waldman, relative to his request to amend the Annexation Agreement. <br /> <br />Mayor Sisk stated he spoke with City Attorney Light relative to possible alternatives. <br />City Attorney Light stated the discussion/direction is being requested to amend the 1986 <br />Faber Annexation Agreement, which is an administrative action. He stressed this is not a <br />hearing on any land use proposal. <br /> <br />Mayor Sisk called for Applicant presentation. <br /> <br />David Waldman, 255 Continental View Drive, Louisville, CO reviewed his request to <br />amend the Faber Annexation Agreement through a slide presentation. The property was <br />annexed to the City in 1985 and zoned Residential Rural (RR). Mr. Waldman requested <br />an amendment to the development restriction, which would permit a subdivision replat of <br />Lot 1, and provide two lots for the purpose of building an additional home. Mr. Waldman <br />proposes to reduce the size of the existing home and construct a second home for his <br />parents. Specifically, 5,300 square feet of the southern portion of the existing home <br />would be tom down and the northern half of the home would be retained. A new 1,000 <br />square foot garage/shop would be built on the northern edge of the property adjoining the <br />existing home. A new 2,700 square foot home (plus garage) would be built on the <br />adjacent 1.5-acre lot, just south of the existing home. He stressed this amendment will <br />enhance the views of the Davidson Mesa. Additionally, he committed to dedicate 1.5- <br />acres to a conservation easement. <br /> <br />Mayor Sisk called for public comment.
