RESOLUTION NO. 38 <br />SERIES 2017 <br />A RESOLUTION APPROVING A PLANNED UNIT DEVELOPMENT (PUD) <br />AMENDMENT TO ALLOW FOR CONSTRUCTION OF A CONNECTION BETWEEN <br />UNIT A & UNIT B AND AN EXTENSION OF THE APPROVED PLANNED UNIT <br />DEVELOPMENT FOR THREE YEARS AT 931 MAIN STREET. <br />WHEREAS, there has been submitted to the Louisville City Council an application <br />for approval of a Planned Unit Development (PUD) amendment to allow for construction of <br />a connection between Unit A & Unit B and an extension of the approved Planned Unit <br />Development for three years at 931 Main Street at Lot 2, Block 5, Town of Louisville <br />Subdivision <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with Louisville Municipal Code Sec 17 28.170, and <br />WHEREAS, after a duly noticed public hearing on June 8, 2017, where evidence <br />and testimony were entered into the record, including the findings in the Louisville Planning <br />Commission Staff Report dated June 8, 2017, the Planning Commission recommended <br />approval of said PUD amendment and PUD extension to the City Council with the following <br />conditions. <br />1 The applicant shall remove the Note 1, the second sentence of Note 2, and the <br />second sentence of Note 3 on the Utility Plan prior to the City Council Public <br />Hearing. <br />2 A parking fee in lieu for one parking space shall be required prior to issuance of <br />a building permit The applicant shall amend Zoning Data table on the cover <br />sheet prior to the City Council Public Hearing to show the requirement for three <br />parking spaces <br />3 The applicant shall include the landscaped areas approved on the 2014 PUD <br />and further define these landscaped areas property prior to the City Council <br />Public Hearing. <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission, and finds that it complies with Chapter <br />17 28 of the Louisville Municipal Code, <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado does hereby approve a Planned Unit Development (PUD) amendment to allow <br />for construction of a connection between Unit A & Unit B and an extension of the approved <br />Planned Unit Development for three years at 931 Main Street with the following conditions: <br />1. Prior to City execution and recordation, the applicant shall remove the City Utility <br />Table and footnote on the Utility Plan and Note No. 1 on the Utility Plan shall be <br />Resolution No 38, Senes 2017 <br />Page 1 of 2 <br />
