3 5 Use of agnchemicals, including but not limited to, fertilizers and biocides, <br />but only in those amounts and with that frequency of application necessary to accomplish <br />reasonable agncultural purposes Such use shall not contaminate surface and ground <br />water or diminish the Property's Conservation Values <br />3 6 Control of predatory and problem ammals by the use of selected control <br />techniques whose effect shall be only upon specific animals or species that have caused <br />or are likely to cause damage to crops, livestock or other property Such control <br />techniques shall not have detrimental impacts upon water quality and the continued <br />permitted uses of the Property The use of leg -hold traps is prohibited <br />3 7 Any use approved by the governing bodies of the Property owners <br />4 Prohibited Uses and Practices The following uses and practices are inconsistent <br />with the purposes of this Easement and shall be prohibited upon or within the Property <br />4 1 Use of the Property in a manner mconsistent with the spirit and purposes <br />stated herein <br />4 2 The change, disturbance, alteration or impairment of the Conservation <br />Values of the Property, except to engage in generally accepted open, non -intensive <br />agncultural activities and passive recreation, and except as otherwise allowed herem. <br />4 3. Construction of any structures on the Property For the purposes of this <br />Easement, structures shall mean a combination of materials forming any edifice, building <br />or man-made formation of any kmd, excluding any yard and play equipment, gates or an <br />individual sewage disposal system that serves the Property's permitted uses, if allowed <br />under this Easement, and any retaimng walls, platforms or decks that he not more than <br />thirty (30) mches above the Property's natural grade, excluding railings <br />4 4 Any use not expressly permitted as a use-by-nght by the Boulder County <br />land use regulations as they apply to the Property, including but not limited to community <br />or institutional uses, golf courses, helicopter pads, and airstnps <br />4 5 Any uses that may be consistent with Boulder County land use regulations <br />as they apply to the Property, but which are mconsistent with the preservation and <br />protection of the Conservation Values of the Property, including but not limited to Active <br />Recreation, intensive agnculture, agnbusiness, commercial, industnal, institutional, <br />community sigmficant, lodging, open mimng, retail, office, business, personal services, <br />transportation, utility, public service, and warehouse uses, and home events of any kind, <br />whether or not a fee is charged or a financial donation is requested or allowed <br />Mayhoffer 3 IGA <br />10 <br />
