DEFINITIONS. The Parties agree that the teens listed below will be defined as follows: <br />A. "City Conduit" means the City owned plastic pipe installed underground typically used for <br />routing or fiber optic cable and as identified on Exhibit A, attached hereto and incorporated <br />herein by reference and the District fiend verified portions of the City's existing traffic signal <br />conduit system, as shown on Exhibit I3, attached hereto and incorporated herein by reference, <br />that will be leased as part of the Agreement. <br />B. "Dedicated City Fiber" means the 12 fiber optic strands to be provided to and owned by the <br />City for its exclusive use throughout portions of the District's east ring, as shown on Exhibits C <br />and D, attached hereto and incorporate;d herein by reference, and the 12 fiber optic strands <br />along the following spur routes that are not part of the east ring, also as shown on Exhibits C <br />and D; <br />1. Washington Ave. between S. Boulder Rd. and the North Water Treatment Plant (1955 <br />N. Washington Ave.); <br />2. Via Appia between McCaslin Blvd. and the Police Station (922 Via Appia) and the <br />Recreation Center (900 Via Appia); <br />3. Spruce St. between Jefferson Ave. and City Hall (749 Main St.); <br />4. Pine St. between Garfield Ave. and the signalized pedestrian crossing (400 block of <br />Pine St.). <br />5. W. Cherry St. between McCaslin Blvd. and W. Dahlia Street; <br />6. Dillon Road between S. 88th Street and S. 96th Street; <br />C. "District Network" means the Boulder Valley School District fiber optic cable infrastructure <br />which will consist of a bundle of 288 fiber optic strands on the backbone and bundles of <br />48, 24 or 12 fiber optic strands on laterals or spurs throughout the District's east ring <br />installed in the City Conduit or in Diistrict provided conduit, as shown on Exhibit D, <br />consistent with the City's Design anti Construction Standards. <br />D. "Fiber" and "fiber optic cable" means a bundle of individual fiber strands. Each fiber strand <br />will be dedicated to providing communications between two or more points along the path of <br />the fiber optic cable. <br />E. "Fiber optic ring" means the cable path that sequentially routes fiber optic cable from an <br />originating point through one or more iintermediate points then back to the originating point. <br />The District will construct two fiber optic rings as part of its Network, as shown on Exhibit E, <br />attached hereto and incorporated hereui by reference. <br />F. "Public right of way" means streets, allleys, roads, lanes, sidewalks, and public rights of way <br />within the City. <br />
