Nl~l lfllllltllfll'~IIIIWpINIpIMI11NVllhp 2940036 <br />IRIY IIfV11NRIUIIIIIIIRl111 <br />ORDINANCE NO. 1535 <br />SERIES 2008 <br />AN ORDINANCE APPROVING A REZONING OF A 4.9-ACRE PARCEL OF LAND <br />LOCATED AT 1125 SHORT STREET FROM CITY OF LOUISVILLE INDUSTRIAL (I) <br />ZONING TO CITY OF LOUISVILLE :MIXED USE RESIDENTIAL (MU-R). <br />WHEREAS, Aggregate Industries-WCR, Inc. is the owner of certain real property totaling <br />approximately 4.9 acres, which property is within the Highway 42 Revitalization Area and the legal <br />description of which is set forth in Exhibit A (the "Property"); and <br />WHEREAS, the landowner of said Property has submitted to the City Council of the <br />City of Louisville a request to approve a rezoning of the Property from Industrial (I) to Mixed <br />Use Residential (MU-R); and <br />WHEREAS, the Louisville Planning Commission has held a public hearing on the <br />proposed rezoning and has forwarded a recommendation to the City Council to approve the <br />rezoning, and the City Council has duly considered the Commission's recommendation; and <br />WHEREAS, the City Staff and Louisville Planning Commission have reviewed the <br />proposed rezoning and found it to comply with comprehensive plan, Louisville zoning <br />regulations and other applicable sections of the Louisville Municipal Code; and <br />WHEREAS, the City Council finds that the request complies with the following goals <br />and polices of the 2005 Citywide Comprehensive Plan: <br />Principle LU-2. The City should maintain a compact urban form to use land <br />efficiently. <br />Policy LU-2.1: The City's development will be contained by well-defined City <br />boundaries. <br />Policy LU-2.2: The City should encourage higher density housing development <br />near transit services and commercial centers to create activity nodes that add to <br />the community's quality of life. <br />Policy LU-2.3: The City should promote mixed-use development as a way to <br />create a walkable and livable community. <br />Policy LU-2.4: The City should review and revise development regulations as <br />needed to promote a high quality of design, redevelopment, mixed-use <br />development, multi-modal transportation opportunities and the protection of <br />natural features. <br />1 <br />R~` <br />
