Council member Brown seconded the motion. <br />All in favor. Council member Keany absent. <br /> <br />ORDINANCE NO. 1449, SERIES 2004 - AN ORDINANCE ARTICLE VI, <br />SECTION 1 OF ORDINANCE NO. 554, SERIES 1997, AS AMENDED BY <br />ORDINANCE NO. 994, SERIES 1989, ORDINANCE NO. 1258, SERIES 1997, <br />ORDINANCE NO. 1296, SERIES 1999, AND ORDINANCE NO. 1378, SERIES <br />2002, TO EXTEND TO AND INCLUDING NOVEMBER 10, 2004, THE <br />ELECTRIC AND GASEOUS FUEL FRANCHISE GRANTED BY THE CITY OF <br />LOUISVILLE, COLORADO TO PUBLIC SERVICE COMPANY OF <br />COLORADO - 1st reading - set public hearing 5/18/04 <br /> <br />Mayor Sisk called for City Attorney introduction. <br /> <br />City Attorney Sam Light read Ordinance No. 1449, Series 2004. <br /> <br />MOTION: Mayor Sisk moved Ordinance No. 1449, Series 2004 be published and a <br />public hearing be set for May 18, 2004. Council member Levihn seconded the motion. <br />All in favor. Council members Marsella and Keany absent. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Sam Light reported on the Virginia Hoyle and Ira Hoyle Family Trust v. <br />City of Louisville, et al., Case No. 02CV1288, Boulder County District Court, Division 3. <br />He requested Council direction for the next step in the process. He reviewed the Council <br />options: 1) Annex the property; 2) Do nothing; 3) Discuss procedures with the Hoyle's <br />and with the IGS partners. He addressed issues raised by Mr. Lopez, and stated the <br />Intergovemmental Governmental Agreement (IGA) overrides the rights of enclave <br />owners and the ruling was not binding on the IGA parmers. <br /> <br />Mayor Sisk voiced his opinion that discussions should commence between the Hoyle's <br />and the IGA parmers. COuncil member Brown concurred. There was Council consensus. <br /> <br />Light addressed the T&T Bennett settlement agreement and noted there have been some <br />survey and title issues, which they are working to resolve. <br /> <br />CITY MANAGER'S REPORT <br /> <br />Deputy City Manager Julie Boyd updated Council on the Capital Projects: Police <br />Department/Municipal Court will be completed by June 1, 2004; Design Phase of New <br /> <br />10 <br /> <br /> <br />
