5/1/134 Page -9- Councilman Leary Inquired of Director Rupp if a building of this nature could be constructed without proper fire safety equipment. r~r. Rupp replied that it was his understand- ing that the County did have rules and regu- lations by which they have to operate within the Fire District and must meet those by a certain degree. But if there is any ex- pansion or making the use more intensive, there is a problem with the Fire District and this may be the case on this issue. Mr. Rupp was not aware of anything that would keep them from operating under their present situation under the Boulder County regulations. He felt it was up to the Fire District if their code was not met to force compliance. Mr. Silverstein interceded and stated that Mr. Trousil did not plan to expand his oper- ation at this time - that information was not correct. Councilwoman Johnson Inquired if the business was operating? Mr. Silverstein stated that it was and would continue to operate even if the request was denied as it is now. He took exception to the comments that this was a smoke screen, stating there is nothing further from the truth. Mr. Trousil wants to protect the place with water of a sprinkler system. Mr. Silverstein stated at that the March 1983 meeting there was concern about if the water got in there someone was going to overuse the water and how that would be monitored. They would be happy to have that monitored by whichever means council deems is appro- priate. Reiterated the water was merely for safes protection of the business. Request Denied Cour.~cilman Luce moved, Councilman Leary seconded that the Trousil water tap request be denied. Richard Silverstein Staged that he would like the Council when it makes its ruling to set forth its speci- fic terms why the request is being denied. And if it is believed, as Councilman Leary indicated, to be concerned about open space there he would like that to be very clearly set forth.
