5/1/134 Page -9- <br />Councilman Leary Inquired of Director Rupp if a building of <br />this nature could be constructed without <br />proper fire safety equipment. <br />r~r. Rupp replied that it was his understand- <br />ing that the County did have rules and regu- <br />lations by which they have to operate within <br />the Fire District and must meet those by <br />a certain degree. But if there is any ex- <br />pansion or making the use more intensive, <br />there is a problem with the Fire District <br />and this may be the case on this issue. <br />Mr. Rupp was not aware of anything that <br />would keep them from operating under their <br />present situation under the Boulder County <br />regulations. He felt it was up to the Fire <br />District if their code was not met to force <br />compliance. <br />Mr. Silverstein interceded and stated that <br />Mr. Trousil did not plan to expand his oper- <br />ation at this time - that information was not <br />correct. <br />Councilwoman Johnson Inquired if the business was operating? <br />Mr. Silverstein stated that it was and would <br />continue to operate even if the request was <br />denied as it is now. He took exception to <br />the comments that this was a smoke screen, <br />stating there is nothing further from the <br />truth. Mr. Trousil wants to protect the <br />place with water of a sprinkler system. <br />Mr. Silverstein stated at that the March 1983 <br />meeting there was concern about if the water <br />got in there someone was going to overuse <br />the water and how that would be monitored. <br />They would be happy to have that monitored <br />by whichever means council deems is appro- <br />priate. Reiterated the water was merely for <br />safes protection of the business. <br />Request Denied Cour.~cilman Luce moved, Councilman Leary <br />seconded that the Trousil water tap request <br />be denied. <br />Richard Silverstein Staged that he would like the Council when <br />it makes its ruling to set forth its speci- <br />fic terms why the request is being denied. <br />And if it is believed, as Councilman Leary <br />indicated, to be concerned about open space <br />there he would like that to be very clearly <br />set forth. <br />
