1/1'7/84 Page -16- <br />.;R Recording Councilwoman Morris referred to 7, in the <br />lettter and commented it did not address <br />whait was brought up at the public meeting. <br />No one was asking to video tape 2 things <br />simultaneously - we were asking to be able <br />to watch something and video tape something <br />else simultaneously. Felt they had addressed <br />than to some degree. Previously she had <br />the capability of doing that with 2 premium <br />channels now she did not. These are the types <br />issues she would like to see pursued. <br />Councilwoman Johnson Dirf.cted her inquiry to Attorney Rautenstraus - <br />Pricing of Premiums in which areas on all these grievances can <br />we pursue them in the legal area. <br />He replied any violations of the. contracts <br />which the City has with the Cable Co. can <br />be pursued. There is difficulty where we <br />would branch outside of actual agreements <br />with the Cable Co, and try to regulate them <br />in :something that wasn't specifically set out <br />in i~he agreement. The pricing can only be <br />dealt with as set forth in the agreement. <br />In answer to Councilwoman Johnson's inquiry <br />about the pricing of the premium increases, <br />Raui~enstraus stated he wished to review it <br />more closely, but felt it would be a tough <br />que:~tion for the City to overcome based on <br />the way it is set-out in the agreement. <br />Councilwoman Johnson inquired of Councilman <br />Cussen how far he wished to pursue this issue. <br />Cussen stated that he didn't want to become <br />involved in a lot of litigation - in fact <br />would like to avoid that. But it appeared <br />to him and again it was a matter of interpre- <br />tation, if we were to review this with the <br />City Attorney, felt that in the agreement it <br />doer talk about making the books and the records <br />open. That the City would so do that - Qh_. <br />Scripps/Howard that is the basis on how that <br />port=ion of the fee that they pay to the City <br />at i~he end of the year - that is the check and <br />bal<~nce for determining whether or not we have <br />recE~ived the correct amount. Felt this was_v~ox'th <br />pur:~uing in a letter to them saying these are <br />council concerns that we feel have not ye•t <br />been addressed and would like them to address <br />them. Reitereated the matter of the package <br />discounts should be in writing. <br />
