No one was asking to video tape 2 things simultaneously - we were asking to be able to watch something and video tape something else simultaneously. Felt they had addressed than to some degree. Previously she had the capability of doing that with 2 premium channels now she did not. These are the types issues she would like to see pursued. Councilwoman Johnson Dirf.cted her inquiry to Attorney Rautenstraus - Pricing of Premiums in which areas on all these grievances can we pursue them in the legal area. He replied any violations of the. contracts which the City has with the Cable Co. can be pursued. There is difficulty where we would branch outside of actual agreements with the Cable Co, and try to regulate them in :something that wasn't specifically set out in i~he agreement. The pricing can only be dealt with as set forth in the agreement. In answer to Councilwoman Johnson's inquiry about the pricing of the premium increases, Raui~enstraus stated he wished to review it more closely, but felt it would be a tough que:~tion for the City to overcome based on the way it is set-out in the agreement. Councilwoman Johnson inquired of Councilman Cussen how far he wished to pursue this issue. Cussen stated that he didn't want to become involved in a lot of litigation - in fact would like to avoid that. But it appeared to him and again it was a matter of interpre- tation, if we were to review this with the City Attorney, felt that in the agreement it doer talk about making the books and the records open. That the City would so do that - Qh_. Scripps/Howard that is the basis on how that port=ion of the fee that they pay to the City at i~he end of the year - that is the check and bal<~nce for determining whether or not we have recE~ived the correct amount. Felt this was_v~ox'th pur:~uing in a letter to them saying these are council concerns that we feel have not ye•t been addressed and would like them to address them. Reitereated the matter of the package discounts should be in writing.
