1/1',7/84 Page -18- <br />~uncilman Leary Inquired of the City Attorney - after a certain <br />period of time if service wasn't satisfactory <br />can that permit be revoked? <br />Attorney Rautenstraus advised that there are <br />provisions to revoke the permit or provisions <br />for the City to take over operation of the <br />system. Of course there are procedures to <br />go through that would include a hearing and <br />obviously some kind of due process for the <br />current permit. holder. <br />Sin<:e there were no further comments by <br />councilmembers, Mayor Meier requested the <br />City Attorney prepare a summary and memo <br />aftE~r going through the agreement and re- <br />view the term regarding increase in rates, <br />and request written correspondence from <br />Scripps/Howard verifying subscribers' choice <br />in 1.he basic Rainbow package. <br />DENVER WATER CONTRACT Administrator Wurl stated as indicated in <br />PROPOSAL a memo sent to council, he thought we were <br />going to have until April 23rd to review <br />and discuss this with the new council - the <br />Denver Water program. This is not so; the <br />latest information received is that we must <br />havf~ the contract signed and in the hands <br />of ithe Denver Water Board by January 24, 1984. <br />As ]ze mentioned in the study session last <br />evening, there is some interest on the part <br />of other people, in that water, if the City <br />of ]Louisville isn't. The Mission Viejo people <br />have expressed a willingness to purchase <br />the City's interest as of May 1, 1984, should <br />the council having approved the Denver contract <br />decade they not want to go through with it, <br />could authorize the option with Mission Viejo <br />and sell that portion of our commitment to <br />thern. So you wouldn't have lost any money in <br />the process Mission Viejo will pay you your <br />costs and whatever we have into it, which <br />would. basically be 40% of the $57,000 that <br />we :have spent on the EIS study to date. <br />Mr. Wurl further stated there were 2 options. <br />We were unable to get the agreement prepared <br />with Mission Viejo for this evening; would <br />have it by Thursday for staff review and didn't <br />anticipate a complex problem. Felt it would <br />be a 2-3 page option, and one option to council <br />
