Cto <br />Louisville <br />COLORADO - SINCE h 78 <br />City Council <br />Study Session Summary <br />September 12, 2017 <br />Library Meeting Room, 951 Spruce Street <br />7:00 PM <br />The City Council met in a study session at 7:00 p.m. in the 1st Floor Meeting <br />Room at the Louisville Public Library at 951 Spruce Street, Louisville, Colorado. <br />The following persons were present: <br />City Council Present: <br />Staff Present: <br />Mayor Bob Muckle <br />Mayor Pro Tem Jeff Lipton <br />Councilmember Jay Keany <br />Councilmember Chris Leh <br />Councilmember Susan Loo <br />Councilmember Dennis Maloney <br />Councilmember Ashley Stolzmann <br />Interim City Manager Balser <br />Rob Zuccaro, Planning Director <br />Meredyth Muth, City Clerk <br />Sam Light, City Attorney <br />Call to Order— The meeting was called to order at 7:04 PM by Mayor Muckle. <br />Discussion/Training — Land Use/Quasi-Judicial Public Hearing Process and <br />Rules <br />City Attorney Light reviewed duties of the Council as quasi -judges in the land use <br />process. He noted the fundamental fairness of process is more important than <br />the decision itself. <br />He reviewed the difference between legislative acts, administrative acts, and <br />quasi-judicial cases. Quasi-judicial cases require notice, a hearing, a record - <br />based decision made by a fair and impartial judge. Redress is in district court and <br />the question is if the process was proper, not the land use proposal itself. <br />He discussed proper procedure, preparation and the hearing process.
