Louisville City Council Meeting <br />August 3, 2004 <br />Page 3 of 5 <br /> <br />Land Management Director Cindy Lair reviewed Resolution No. 35, Series 2004. The <br />City of Louisville intends to acquire fee title to a 3.97-acre portion of the Warembourg <br />Parcel 2 Property, which will be defined as the "Community Park Parcel". The parcel is <br />to be acquired for potential park, right-of-way and other governmental purposes, <br />including but not limited to construction of trails and Community Park amenities and <br />facilities. As part of this acquisition, the 3.97-acre Community Park Parcel is to be <br />released from the City-County Conservation Easement. Resolution No. 35, Series 2004 <br />authorizes the mayor and city manager to negotiate and approve the conditions for <br />amending the conservation easement, provided the essential terms and conditions of the <br />Amendments and Easements are not altered. <br /> <br />City Attorney Sam Light distributed copies of the amended Resolution No. 35, Series <br />2004, and reviewed the changes. <br /> <br />Mayor Pro-Tem Keany requested public comment. There were no comments. <br /> <br />MOTION: Council member Marsella moved for approved Resolution No. 35, Series <br />2004, seconded by Council member Levihn. <br /> <br />Council member Van Pelt offered a friendly amendment that the motion incorporate the <br />additional language suggested by the City Attorney. Council members Marsella and <br />Levihn accepted the amendment. <br /> <br />City Attorney Light clarified the amended Resolution No. 35, Series 2004 contains the <br />authorization for payment to the County. <br /> <br />VOTE: Roll call vote was taken. The motion carried by a vote of 5-0. Mayor Sisk and <br />Council member Brown were absent. <br /> <br />ORDINANCE NO. 1453, SERIES 2004 - AN ORDINANCE APPROVING THE <br />VACATION OF A 50-FOOT BY 60-FOOT PORTION OF THE SOUTH FRONT <br />STREET RIGHT-OF-WAY LOCATED BETWEEN BLOCK 8 AND BLOCK 9 IN <br />THE MURPHY PLACE SUBDIVISION IN THE CITY OF LOUISVILLE - 1st <br />reading - set public hearing 9/7/04 <br /> <br />Mayor Pro-Tem Keany requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1453, Series 2004 and explained the first reading <br />of the ordinance comes forward with the Planning Commission's recommendation for <br />disapproval. He explained the Charter requires two readings of each ordinance. <br /> <br />MOTION: Council member Levihn moved to publish Ordinance No. 1453, Series 2004 <br />and set a public hearing for September 7, 2004, seconded by Council member Van Pelt. <br />Roll call vote was taken. The motion carried by a vote of 5-0. Mayor Sisk and Council <br />member Brown were absent. <br /> <br /> <br />
