5 That there are no reasonable alternatives that would remove <br />the need for the requested modification or would reduce the amount of the <br />modification <br />6 That no additional dwelling units shall result from approval <br />of the modification beyond what the underlying zoning would otherwise allow <br />B In granting any modification for a subdivision that is processed <br />concurrently with a planned unit development, city council shall find the <br />application complies with Sec 16 24.010 and all of the following requirements, <br />insofar as applicable, have been satisfied <br />1 The modification, if granted, will not alter the essential <br />character of the neighborhood or distract in which the property is located, nor <br />substantially or permanently impair the appropriate use or development of <br />adjacent property, <br />2 The modification is necessary to meet the purposes set <br />forth in Sec 17 28 010, <br />3 The modification is warranted by the design and amenities <br />incorporated in the development plan, and the needs of residents for usable or <br />functional open space and buffer areas can be met, <br />4 There are no reasonable design alternatives that would <br />remove the need for the requested modification or would reduce the amount of the <br />modification required, <br />5 No additional dwelling units shall result from approval of <br />the modification beyond what the underlying zoning would otherwise allow <br />Section 9. Section 17 08 265 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined, words deleted are stneken-difet ) <br />Sec. 17.08.265. — Lot <br />Lot means a parcel of land of at least sufficient size to meet minimum <br />requirements for use, coverage, and area, and to provide required yards and other open <br />spaces Such lot shall have frontage on an improved public street, or on an approved <br />pnvate street, exclusive of public or private alleys. and may consist of the followmg, <br />provided that in no case of division or combination shall any residual lot or parcel be <br />created which does not meet the requirements of this title <br />A A single lot of record, <br />B A portion of a lot of record, <br />C A combmation of complete lots of record, of complete lots of record and <br />portions of lots of record, or portions of lots of record; <br />Ordinance No 1747, Senes 2018 <br />Page 5 of 7 <br />
