B. Design -Build Firm's Responsibility with respect to design phase of the Project (also <br />referred to as the Preconstruction Phase). <br />1. The Design -Build Firm shall prepare and the City shall approve a Preconstruction <br />Phase schedule, including the following: <br />a. PHASE I — SITE ANALYSIS AND DESIGN APPROACH: Review site <br />and Owner's plan for the project. <br />b.PHASE 2 — CONCEPTUAL DESIGN: Develop conceptual and <br />preliminary design to advise City concerning site use and improvements, <br />selection of materials, building systems and equipment. Provide <br />recommendations on construction feasibility, availability of materials and <br />labor, time requirements for installation and construction and factors <br />related to cost including costs of alternative designs or materials, <br />preliminary budgets and possible economies. <br />c.PHASE 3 — SCHEMATIC DESIGN: Prepare preliminary plans, develop <br />project budget. <br />d.PHASE 4 — DESIGN DEVELOPMENT: Upon approval of Schematic <br />Designs and authorization from the City to proceed, the Design -Build <br />Firm shall prepare Design Development documents to fix the size and <br />character of the project as to structural, mechanical, materials, and other <br />appropriate essential items in the Project. These Development <br />Documents shall be the basis for the design and construction of the <br />Project. <br />e.PHASE 5 — CONSTRUCTION DRAWINGS AND SPECIFICATIONS: <br />From approved Design Development Documents, the Design -Build Frim <br />will prepare construction drawings and Specifications setting forth in <br />detail the requirements for the construction of the Project, and based <br />upon codes, laws, or regulations. <br />2. The Design -Build Firm and the City will work closely together to monitor the <br />design in accordance with prior approvals so as to ensure that the Project can be <br />constructed within the amount of time as defined in Section 5. As Construction <br />Drawings and Specifications are being completed, the Design -Build Firm will <br />keep the City advised of the effects of any City requested changes on the <br />Contract Time Schedule and/or the Total Contract Amount. Construction of the <br />Project shall be in accordance with these Drawings and Specifications as <br />approved by the City and incorporated in exhibits. These Drawings and <br />Specifications shall remain the property of the City and may be used by the City <br />on this or other projects without the written consent of the Design -Build Firm. <br />C. Upon the completion of the Preconstruction Phase Services, the parties may enter into a <br />Guaranteed Maximum Price ("GMP") for the construction of the Project. If the parties <br />agree to a GMP, the GMP shall be added to this Agreement by amendment ("GMP <br />Amendment"). If the parties agree to a GMP Amendment to this Agreement as provided <br />for herein, the Design -Build Firm shall furnish and install all labor, materials and <br />equipment and fully perform and complete the work required for the project, all in strict <br />accordance with the Contract Documents, which are made a part of this Agreement. <br />6 <br />
