Louisville City Council Meeting <br />September 21, 2004 <br />Page 7 of 11 <br /> <br />MOTION: Mayor Sisk moved that Council adopt Ordinance No. 1455, Series 2004, on <br />second and final reading, with the provision that any building greater than 300,000 SF <br />would be modified, whereby retail establishment would be limited to 30,000 SF, and <br />assisted living and skilled nursing facilities would be use by Special Review, and a <br />provision added to the General Development Plan relative to the access movements <br />shown on the PUD are subject to change. The motion was seconded by Council member <br />Levihn. <br /> <br />City Attorney Light suggested a friendly amendment to approve the general development <br />plan and authorization for the Mayor to sign the PCZD agreement. Mayor Sisk and <br />Council member Levihn accepted the amendment. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 7-0. <br /> <br />ORDINANCE NO. 1456, SERIES 2004 - AN ORDINANCE ZONING PROPERTY <br />KNOWN AS THE HOYLE PROPERTY - 1st reading - set public hearing 10/19/04 <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Sam Light read Ordinance No. 1456, Series 2004. He explained the <br />Planning Department will advertise October 19, 2004 as the public hearing. <br /> <br />Richard Lopez, Attomey representing the Applicant, requested that Council direct Staff <br />to communicate with the Applicant and provide council packet materials relative to the <br />Hoyle Property Zoning. Mayor Sisk assured Mr. Lopez that Staff would be so directed. <br /> <br />MOTION: Mayor Sisk moved that Council send Ordinance No. 1456, Series 2004 out <br />for publication and set a public heating for October 19, 2004, seconded by Council <br />member Levihn. All in favor. <br /> <br />RESOLUTION NO. 43, SERIES 2004 - A RESOLUTION APPROVING AN <br />INTERGOVERNMENTAL AGREEMENT FOR INTERCHANGE <br />IMPROVEMENTS BETWEEN THE CITY OF LOUISVILLE AND THE TOWN <br />OF SUPERIOR, FOR IMPROVEMENTS TO THE MCCASLIN <br />BOULEVARD/US 36 INTERCHANGE <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Assistant City Manger for Governmental Relations Heather Balser reported on the most <br />recent copy of the IGA between Louisville and Superior regarding improvements at the <br />McCaslin Interchange. Changes since the last draft address the timing of design, <br />budgeting and a finance plan to accommodate the new uncertainties surrounding the <br />Environmental Impact Statement for US 36 and the large number of alternatives for the <br />Second Phase Improvements, which may or may not accommodate the northeast loop. <br />Superior approved the draft prepared by the Louisville City Attorney, with a few changes <br /> <br /> <br />
