Louisville City Council Meeting <br />October 5, 2004 <br />Page 4 of 9 <br /> <br />Mayor Sisk requested an applicant presentation. <br /> <br />Mr. Paul Hu, P.O. Box 66043, Tucson, AZ, stated he has owned the property for thirty- <br />five years. He explained the proposal is a win/win situation for the City. It provides <br />right-of-way access for Highway 42, a drainage easement and additional housing units. <br /> <br />COUNCIL COMMENT <br /> <br />Council member Van Pelt asked if the Highway 42 Revitalization project would be <br />impacted by this proposal. Planning Director Wood responded no. <br /> <br />Council member Brown expressed concern for the lack of quiet title. City Attorney Light <br />stated the applicant would have to complete a quiet title to secure title for his property, <br />but proposes to dedicate the southeasterly portion to the City and noted the parcel is <br />surrounded by city-owned land. <br /> <br />Lee W. Stadele, PLS, Flagstaff Surveying, Inc, 637 South Broadway, Suite C, Boulder, <br />CO, stated his company conducted a thorough research for the title to the property, <br />without success. <br /> <br />Mayor Sisk asked Mr. Hu if he has had continued possession of the property. Mr. Hu <br />confirmed that he has owned the property for 35 years. <br /> <br />MOTION: Council member Brown moved for Council approval of Resolution No. 44, <br />Series 2004. Council member Clabots seconded the motion. All in favor. <br /> <br />ORDINANCE NO. 1457, SERIES 2004, AN ORDINANCE AMENDING <br />CHAPTER 5.08 OF THE LOUISVILLE MUNICIPAL CODE TO ADOPT <br />STANDARDS, PROCEDURES, AND FEES FOR APPLICATIONS FOR LIQUOR <br />TASTINGS AT RETAIL LIQUOR STORES AND LIQUOR-LICENSED DRUG <br />STORES - 1st reading - set public hearing 10/19/04 <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1457, Series 2004. <br /> <br />MOTION: Mayor Sisk moved to send Ordinance No. 1457, Series 2004 out for <br />publication and set a public hearing for October 19, 2004. Council member Levihn <br />seconded the motion.
