Louisville City Council Meeting <br />October 19, 2004 <br />Page 4 of 15 <br /> <br />PUBLIC COMMENT <br /> <br />Jay Berger, 1016 Main Street, Louisville, CO voiced his appreciation for Council's <br />policy changes. He reviewed the history of the Citizen's Initiative that brought forth <br />Ballot Issue 200. He commented that all the newspapers have endorsed Ballot Issue 200. <br /> <br />Bob Muckle, 1101 Lincoln Avenue, Louisville, voiced his thanks and support of the <br />Statement of Policies and Procedures. <br /> <br />MOTION: Council member Brown moved for Council adoption of the Statement of <br />Policies and Procedures regarding City Council meetings and study sessions, seconded by <br />Council member Keany. Roll call vote was taken. The motion carried by a vote of 7-0. <br /> <br />ORDINANCE NO. 1453, SERIES 2004 - AN ORDINANCE APPROVING THE <br />VACATION OF A 50-FOOT BY 60-FOOT PORTION OF THE SOUTH FRONT <br />STREET RIGHT-OF-WAY LOCATED BETWEEN BLOCK 8 AND BLOCK 9 IN <br />THE MURPHY PLACE SUBDIVISION IN THE CITY OF LOUISVILLE - 2na <br />reading - public hearing continued from 9/7/04 (advertised Daily Camera 8/7/04) <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Paul Wood reviewed the applicants, Kenneth and Bernadine Sawyer of <br />224 Front Street, and Philip and Denise Ehrmann of 221 Front Street, request to vacate <br />the full-width portion of the Front Street right-of-way between Lots 16 and 17, Block 8 <br />(221 Front Street) and Lots 10 and 11, Block 9 (224 Front Street) Murphy Place <br />Subdivision. The area proposed for vacation is the platted street right-of-way, which is 60 <br />feet wide and is 50 feet long (3,000 sq. ft.). The parcel is a portion of Front Street and <br />was platted as part of the Murphy Place Subdivision in 1907. The parcel represents 50 <br />feet of Front Street as it dead-ends into a parcel acquired by the City and platted as the <br />Community Park. The Community Park parcel is located adjacent to and immediately <br />south of the Murphy Place Subdivision. The first reading of the ordinance was August 3, <br />2004, and a public hearing was conducted September 7, 2004. Council continued the <br />heating to October 5, 2004 for purpose of evaluating a compromise request submitted by <br />the applicant's counsel. Staff requested the public hearing be continued to October 19, <br />2004 to allow additional time to draft a response position to the applicants. <br /> <br />Wood reviewed the following two options, which were presented to the applicant: In <br />Option #1, the City would grant the applicants a license agreement deferring its tight of <br />possession until such time as one of the adjoining property owners, or applicants were to <br />sell their property. Upon termination of the license agreement the City would take <br />possession of the full 60' width of right-of-way. Option #2 would take immediate <br />possession of a portion (15'-20') of the right-of-way for the exclusive use of the City for <br />pedestrian, bike and emergency vehicle access. The balance of the right-of-way would <br />be vacated in accordance with state statute to the adjoining property owners. <br /> <br /> <br />
