Louisville City Council Meeting <br />October 19, 2004 <br />Page 5 of 15 <br /> <br />In response, Counsel for the applicant submitted a letter, which did not accept either of <br />the two options. The letter outlined a proposal requiring the City to vacate all of the <br />right-of-way with the exception of 18 feet, but would not allow the City to take <br />possession of the 18' for the term of the proposed license agreement. The term of the <br />license agreement would terminate at such time as, "either 221 or 224 Front Street, or <br />both, are not owned and occupied by Ken or Bernadine Sawyer or by a lineal descendant <br />of Ken and Bernadine Sawyer". <br /> <br />Mayor Sisk requested Ordinance No. 1453, Series 2004, be delayed a few minutes to <br />review the Hoyle Matter. <br /> <br />ORDINANCE NO. 1456, SERIES 2004 - AN ORDINANCE ZONING PROPERTY <br />KNOWN AS THE HOYLE PROPERTY - 2nd reading - public hearing (advertised <br /> Daily Camera 9/25/04 [applicant requests continuance to February 1, 2005] <br /> <br />Mayor Sisk explained the City received a letter from Richard Lopez, Counsel for the <br />Applicants, requesting a continuance on the second reading of Ordinance No. 1456. <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1456, Series 2004. <br /> <br />MOTION: Mayor Sisk opened the public hearing and moved to continue Ordinance No. <br />1456, Series 2004 to February 1, 2004. Council member Brown seconded the motion. <br />All in favor. <br /> <br />ORDINANCE NO. 1453, SERIES 2004 - CONTINUED <br /> <br />Mayor Sisk opened the public hearing and requested an applicant's presentation. <br /> <br />Claire Levy, 3172 Redstone Road, Boulder, CO, Counsel for the applicant, distributed <br />copies of aerial maps of the site to the Mayor and City Council. She reviewed the history <br />of the property, and explained there are human elements as well as the historic use of the <br />property. She noted that Front Street does not connect to the park and any public access <br />would eliminate the homeowners' access to their homes. She addressed the other options <br />for pedestrians to access the park. She voiced the applicant's belief that the City has <br />abandoned the right-of-way. She questioned why the City must have the property. She <br />reviewed the applicant's proposal. She suggested the second reading of the ordinance be <br />continued to allow the applicant's participation in the discussions regarding options. <br /> <br />PUBLIC COMMENT <br /> <br />Chris Wecker, 115 W. Cherry Street, Louisville, CO stated Louisville has gone through <br />many changes. She reviewed the history of the property, which belonged to her family, <br />and eventually will become the Community Park. She supported the Sawyer family. <br /> <br /> <br />
