Louisville City Council Meeting <br />December 21, 2004 <br />Page 6 of 8 <br /> <br />Mayor Sisk reported on the draft IGA regarding the Biella Menkick property. Mayor <br />Sisk, City Attorney Light and City Staff met with Superior Mayor Mark Hamilton, the <br />Town Attorney and Superior Staff to discuss the proposed changes to the draft on <br />Thursday, December 16. The major issues still under discussion are as follows: Phasing <br />Plan for Retail Construction; Duration of No Impairment Clause; and Area Covered by <br />No Impairment Clause. He voiced his concern over the duration of no impairment clause <br />and area covered by no impairment clause. Those issues could have an economic impact <br />to the City if Louisville businesses chose to relocate to Superior. <br /> <br />Council member Brown reviewed the history of the Biella Menkick Intergovernmental <br />Agreement to share sales tax at a future development site in Superior. He noted the City <br />would proceed in the best interest of the Louisville citizens. <br /> <br />UPDATE - LOUISVILLE PUBLIC LIBRARY PROJECT <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Deputy City Manager Julie Boyd updated Council on the Louisville Public Library <br />Project. Staff presented the project plans to the Planning Commission on December 14. <br />Staff received an updated cost estimate for the library construction project based on the <br />50% design development drawings, and an updated construction schedule, which <br />proposes construction to begin in late February. She noted the Xcel utility boxes must be <br />relocated before construction begins. She addressed the shoring of the building, and <br />price estimates. She noted that meetings will be on-going in January with business <br />owners. One item of discussion will be long-term parking. She announced the next <br />Library Steering Committee meeting will be held Wednesday, December 22. <br /> <br />Council discussion centered on loss of meeting rooms at the Library; meetings with local <br />businesses; and the next set of cost estimates. Mayor Sisk stressed the importance of the <br />City including the local business owners in the meetings. City Manager Simmons <br />reported there are two pending offers for the existing Library building. The City will <br />contact its realtor to make a counter-proposal. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Light advised Council of a request for public record for police accidents <br />reports through the City Clerk's office. He explained the Police Department is the <br />custodian of police accident reports, and the applicant has instead filed with the City <br />Clerk's Office to obtain those records. The City Clerk denied the request and has <br />referred the applicant to the police department. He noted other jurisdictions have also <br />received such requests from the same individual. He explained that in order to obtain <br />criminal justice records a requestor must sign a document stating the records will not be <br />used for commercial use. No such document is required when filing through the City <br />Clerk's Office. Light informed Council that this matter may be filed in District Court. <br /> <br />6 <br /> <br /> <br />
