City Council <br />Special Meeting Minutes <br />November 3, 2008 <br />Page 5 of 16 <br />Councilor Muckle proposed the City develop a long term financial plan on how <br />the City will provide maintenance of the cemetery. <br />Mayor Sisk requested public comment and hearing none, closed the public <br />hearing. <br />MOTION: Councilor Dalton moved to approve Ordinance No. 1542, Series 2008, <br />on second and final reading, seconded by Mayor Pro Tem Marsella. Roll call <br />vote was taken. The motion carried by a vote of 7-0. <br />ORDINANCE No. 1543, SERIES 2008 - AN ORDINANCE APPROVING THE <br />VACATION OF CERTAIN EASEMENTS WITHIN BLOCK 10 OF THE NORTH <br />END SUBDIVISION -Public Hearing <br />Mayor Sisk requested a City Attorney introduction. <br />City Attorney Light read Ordinance No. 1543, Series 2008 <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br />Planning Director Wood explained the applicant/owner, North End Properties <br />LLC, is requesting City authorization to vacate its interest in a series of utility and <br />access easements limited to Block 10 of the North End Subdivision. The interest <br />in those public access and utility easements were dedicated to the City in <br />conjunction with the approval of the North End Subdivision. <br />The applicant is also requesting a re-plat of the Block 10 for the purpose of <br />revising the location of the access and utility easements to reflect their revised <br />building layout. The interests in public access and utility easement will be <br />relocated and conveyed to the City as part of an authorization of a subdivision re- <br />plat request. Block 10 is undeveloped and as the Final Development Plan did <br />not include building placement on Block 10, there is no need to revise the Final <br />Development Plan. <br />The applicant revision to their building layout will not result in an increase to the <br />number of units permitted on Block 10 of Planning Area #4, which was approved <br />for 96 units. The action will not amend or increase entitlements of the North End <br />General Development Plan and there is no fiscal impact. <br />APPLICANT PRESENTATION <br />Michael Markel stated he was available to respond to Council questions. <br />COUNCIL COMMENTS <br />21 <br />
