TO: MAYOR SISK AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: SEPTEMBER 9, 2008 <br />SUBJECT: DISCUSSION -PROPOSED AMENDMENTS TO CITY CODE <br />REGARDING OPEN BURNING, FIRE PITS, AND PORTABLE FIRE <br />PLACES <br />ORIGINATING DEPARTMENT: POLICE DEPARTMENT <br />SUMMARY: <br />The Louisville Fire Department, the Louisville Police Department, and the City Manager's Office <br />recommend modifying the Municipal Code to reduce citizen misunderstandings about open <br />burning and the prohibited use of portable fire places, e.g., fire pits, fire tables, or chimineas. <br />The City of Louisville adopted by reference the International Fire Code into the Louisville <br />Municipal Code, Chapter 15-12. <br />Sec. 15.12.010. Adoption. <br />"The International Fire Code, 2003 Edition, published by the International Code <br />Council, 4051 West Flossmoor Road, Country Club Hills, Illinois, 60478-5795, is <br />hereby adopted by reference thereto and incorporated into and made a part of this <br />Code. The purpose and subject matter of the International Code Council include <br />minimum standards relating to the storage, handling, and use of hazardous <br />substances, materials and devices, and providing greater safety and protection to <br />the public from conditions hazardous to life or property in the occupancy of <br />buildings or premises." <br />(Ord. No. 1427-2003, § 5, 10-7-2003) <br />Current Code -Section 307: Open burning and recreational fire. <br />"A permit shall be obtained from the fire code official in accordance with section 105.6 prior to <br />kindling a fire. " <br />Current Code -Section 307.2.2: Prohibited open burning. <br />"Open burning that will be offensive or objectionable because of smoke or odor emissions <br />when atmospheric conditions or local circumstances make such fire hazardous shall be <br />prohibited. The fire official is authorized to order the extinguishment by the permit holder or the <br />fire department of open burning which creates or adds to a hazardous or objectionable <br />situation.
