D No adoption of any proposed policy, position, resolution, rule, <br />regulation, or formal action, and no informal or "straw" vote, shall occur at any <br />executive session. <br />Sec. 2.18.100. — Executive sessions — authorized topics. <br />Topics which may be discussed in an executive session shall be limited to <br />the following - <br />A. Matters where the information being discussed is required to be <br />kept confidential by federal or state law; <br />B. Personnel matters involving the dismissal, demotion, discipline or <br />review of the performance of employees directly appointed by the council, <br />consideration of complaints or charges against employees appointed directly by <br />the council, and other personnel matters only upon request of the city manager or <br />Mayor for informational purposes only, <br />C. Consideration of water nghts and real property acquisitions and <br />dispositions by the city, but only as to appraisals and other value estimates and <br />strategy for the acquisition or disposition of such nghts or property; and <br />D Consultation with an attorney representing the city with respect to <br />pending litigation Pending litigation shall include cases in which a lawsuit is <br />actually commenced, and any situation where the person requesting the executive <br />session believes m good faith that a lawsuit may result. The council may discuss <br />settlement strategies in an executive session. <br />Sec. 2.18.110. — Executive sessions — authorized participants. <br />A. The mayor and all councilmembers shall be entitled to participate <br />in all portions of all executive sessions, except where recusal is required by the <br />Code of Ethics. In addition, the city manager, any attorney representing the city, <br />the city clerk, the city treasurer, and department heads shall be authorized to <br />participate in an executive session, unless excluded by a majonty vote of the city <br />council during the public portion of the meeting In addition, the city council may <br />allow any other person to participate in an executive session if the name of the <br />individual is made part of the initial request to hold the executive session. <br />B. If during an executive session, the city council may desire the <br />presence of any additional person in the executive session, then the city council <br />shall reconvene in open session, announce the name of the individual, and upon a <br />two-thirds (2/3) vote of the membership approving such participation, shall return <br />to the executive session with the additional person in attendance. <br />Ordinance No 1753, Senes 2018 <br />Page 22 of 62 <br />
