Louisville Local Licensing Authority <br />Meeting Date: September 29, 2003 <br />Page 3 of 5 <br /> <br />Eric Johnson representing Hei Han Enterprises, Inc., d/b/a Henry's Bar and Grill, stated <br />he is authorized to enter his appearance and a plea in behalf of Mr. Hei, who is sick and <br />unable to attend the hearing. Mr. Johnson stated his client has admitted the allegations <br />in the show cause order. <br /> <br />Special Prosecutor Mark Shapiro, representing the City of Louisville, stated he had <br />discussions with Mr. Johnson and they have reached an understanding. He stated Mr. <br />Johnson is prepared to concede to the allegations set forth in the show cause and <br />would present mitigation to the authority through testimony of witnesses. <br /> <br />Johnson stated he is authorized to admit allegations to the extent that it is probable an <br />intoxicated person was served on the evening in question. He called for witness <br />statements. <br /> <br />City Clerk Varra swore in Ray Townsend. <br /> <br />Ray Townsend, 801 Lincoln Avenue, Louisville, CO, a two-year patron of Henry's, <br />stated on the night in question, he attended a Hazel Miller concert, and then went to <br />Henry's at approximately 8:45 p.m. He noted the bartender on duty left the <br />establishment and was replaced by Sara Walters. He voiced his opinion there was no <br />violation and it was a case of police harassment. <br /> <br />Authority members asked Townsend several questions for clarification. <br /> <br />City Clerk Varra swore Lori Taylor. <br /> <br />Lori Taylor, 801 Lincoln Avenue, Louisville, CO reported going to Henry's after the <br />Hazel Miller Concert. She noted the bar was extremely busy and the bartender left with <br />family problems, leaving Sara Walters to attend the bar. Taylor assisted Walters in <br />doing dishes and closing the bar. She smoked a cigarette outside and became ill from <br />something she had eaten. She stated she has been bar patrons for two years and has <br />never seen a bartender intoxicated on duty. <br /> <br />Authority members asked Taylor questions for clarification. <br /> <br />City Clerk Varra swore in Ron Hitchcock. <br /> <br />Ron Hitchcock, 627 Pine Street, Louisville, CO reported arriving at Henry's at <br />approximately 10:00 p.m., and observed the change of bartenders. He came back at <br />11:00 p.m., ordered a beer, and was questioned by police relative to the person who <br />had vomited outside the bar. The bartender was interviewed and given a Breathalyzer <br />test.
