RESOLUTION NO. 12, <br /> SERIES 2010 <br /> A RESOLUTION RECOMMENDING APPROVAL OF A SPECIAL REVIEW USE <br /> (SRU) TO ALLOW FOR OUTDOOR SEATING FOR AN EATING AND DRINKING <br /> ESTABLISHMENT LOCATED ON THE SOUTHERN 35 FEET OF <br /> LOT 8, BLOCK 2, LOUISVILLE OLD TOWN (808 MAIN ST.). <br /> WHEREAS, there has been submitted to the Louisville Planning Commission an <br /> application for approval of a request for a special review use (SRU) to allow for outdoor <br /> seating for an eating and drinking establishment located on the southern 35 feet of Lot <br /> 8, Block 2, Louisville Old Town (808 Main St.); and <br /> WHEREAS, the City Staff has reviewed the information submitted and found it, <br /> with conditions, to comply with Louisville zoning regulations, required general and <br /> specific design standards as set forth in Section 17.42.030, and the City's special <br /> review use criteria and other applicable sections of the Louisville Municipal Code; and <br /> WHEREAS, after a duly noticed public hearing on May 13, 2010, where <br /> evidence and testimony were entered into the record, including the findings in the <br /> Louisville Planning Commission Staff Report date May 13, 2010, the Planning <br /> Commission finds that said special review use should be approved, with the following <br /> conditions; <br /> 1. The outdoor dining area shall not be used past closing time on any given day or, <br /> at the latest, past 12 AM. <br /> 2. This SRU is granted to the applicant only and may not be transferred to a <br /> different business at this location. <br /> 3. The outdoor music on the patio will be turned off after closing time each evening <br /> or, at the latest, by 12 AM. <br /> NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the City of <br /> Louisville, Colorado does hereby approve a special review use (SRU)to allow for <br /> outdoor seating for an eating and drinking establishment located on the southern 35 feet <br /> of Lot 8, Block 2, Louisville Old Town (808 Main St.), subject to the above conditions. <br /> PASSED AND ADOPTED this 13th day of May, 2010. <br /> By: <br /> Chris Pritchard, Vice Cha' <br /> Planning Commission <br /> 4110" APIF <br /> Attest: � ,G <br /> • an S.
