RESOLUTION NO. 09 <br /> SERIES 2010 <br /> A RESOLUTION RECOMMENDING APPROVAL OF A SPECIAL REVIEW USE <br /> (SRU) TO ALLOW FOR THE OPERATION OF A PRIVATE SCHOOL ON A <br /> PROPERTY LOCATED AT 1436 MAIN STREET AND ZONED COMMERCIAL <br /> NEIGHBORHOOD (CN) <br /> WHEREAS, there has been submitted to the Louisville Planning Commission an <br /> application for approval of a Special Review Use (SRU) to allow for the operation of a <br /> private school on property located at 1436 Main Street and zoned Commercial <br /> Neighborhood (CN); and <br /> WHEREAS, the City Staff has reviewed the SRU application and found it, with <br /> conditions, to comply with Louisville zoning regulations, required general and specific <br /> design standards as set forth in Section 17.42.030 of the Louisville Municipal Code, the <br /> special review use criteria as set forth in Section 17.40.100 of the Louisville Municipal <br /> Code, and other applicable requirements; and <br /> WHEREAS, after a duly noticed public hearing on May 13, 2010, where evidence <br /> and testimony were entered into the record, including the findings in the Louisville <br /> Planning Commission Staff Report dated May 13, 2010, the Planning Commission <br /> recommends approval of the SRU to the City Council, with the following conditions; <br /> 1. The applicant shall develop a staggered start time schedule so there is no traffic <br /> conflict in the already established drop-off zone. <br /> 2. Patchwork Elementary Staff shall use the existing off-street parking on the <br /> subject property. <br /> 3. The maximum number of students at any one time shall not exceed 20 students. <br /> 4. The rear fencing shall be 6' in height and shall have only one locked gate. <br /> 5. Trash recycling area shall be consistent with the regulations established in the <br /> Louisville Municipal Code. <br /> 6. Approval of this SRU is for the applicant only. <br /> NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the City of <br /> Louisville, Colorado does hereby recommend approval of a Special Review Use (SRU) <br /> to allow for the operation of a private school on property located at 1436 Main Street <br /> and zoned Commercial Neighborhood (CN), with the above conditions. <br /> PASSED AND ADOPTED this 13th day of May, 2010. <br /> By: <br /> Chris Pritchard, Vice-chair <br /> Planning Commission <br /> de, <br /> Attest: 40 <br /> • an S.
