RESOLUTION NO. 20 <br />SERIES 2018 <br />A RESOLUTION APPROVING A SECOND INTERIM AGREEMENT BETWEEN THE <br />NORTHERN COLORADO WATER CONSERVANCY DISTRICT ACTING BY AND <br />THROUGH ITS SOUTHERN WATER SUPPLY PROJECT WATER ACTIVITY <br />ENTERPRISE, AND THE CITY OF LOUISVILLE FOR PARTICIPATION IN THE <br />SOUTHERN WATER SUPPLY PROJECT, EASTERN PHASE <br />WHEREAS, a Second Interim Agreement for Increasing the Capacity of the Southern <br />Water Supply Project, Eastern Phase ("Agreement") has been proposed to further identify the City's <br />2018 funding obligation for the Eastern Phase of the Southern Water Supply Project ("SWSP"), and <br />WHEREAS, the City Council desires to approve such Agreement and authorize its <br />execution <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1 The proposed Second Intenm Agreement for Increasmg the Capacity of the <br />Southern Water Supply Project, Eastern Phase ("Agreement") between the Northern Colorado <br />Water Conservancy District, acting by and through its Southern Water Supply Project Water <br />Activity Enterpnse and the City of Louisville is hereby approved in essentially the same form as the <br />copy of such Agreement accompanying this Resolution <br />2 The Mayor is authorized to execute such Agreement, except that the Mayor is <br />hereby granted the authority to negotiate and approve such revisions to said Agreement as the <br />Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the Agreement are not altered <br />3 The Mayor, City Manager and City Staff are further authonzed to do all things <br />necessary on behalf of the City to perform the obligations of the City under such Agreement <br />PASSED AND ADOPTED this 17th day of April, 2018 <br />P <br />Robert P Muckle, Mayor <br />
