Board of Adjustment <br />Meeting Minutes <br />November 15, 2017 <br />Page 8 of 9 <br />During the correspondence between Sonya and the applicant, Sonya says that she <br />hopes to support the applicant under the conditions discussed in her email and wishes <br />the applicant good luck and best wishes. <br />Williams closes the public hearing again and discussion by the board continues. <br />Stuart starts by saying that adding onto the house does not provide that great of a <br />hardship and believes each criteria is met. Precedence will not be a concern and <br />conditions being put on future homeowners will not cause an issue. This addition will not <br />affect anyone except two neighbors and the neighbors have already given their support <br />to the applicant. Stuart mentions that neighbors' opinions are important for his decision <br />making. <br />Ewy says that the neighbors support and the understanding of precedence which was <br />discussed earlier is making her inclined to support this application. She still struggles <br />with how to fully approve this when it still does not meet any of the criteria. She notices <br />that the first criteria will be the key to attaining criterions two through four. <br />Meseck states that he is having a hard time getting over the hardship aspect as well. <br />Williams says she understands where Stuart is coming from and would rely more so on <br />the neighbors' opinion if five out of the six criteria were being met but because none of <br />them are met, she cannot rely solely on neighbor opinions. <br />Meseck says he tries not to put too great of an emphasis on neighbors opinions. These <br />variance decisions should be based solely on the six criteria. <br />The board decides to make a motion to approve the variance with these five conditions: <br />Converting the upstairs balcony to a window, the windows be frosted and fixed, snow <br />guards shall be added on the south elevation of the garage, screening will be on the <br />landing of the stairs in the garage, making the railing opaque, and adding a down spout <br />location onto the property. <br />Motion made by Stuart to approve 812 La Farge Avenue, a variance from Section <br />17.12.050 of the Louisville Municipal Code (LMC) Old Town Overlay zone district <br />requirement a maximum floor area ratio of 0.50 to allow a floor area ratio of 0.63 to <br />construct an addition to the principal structure and construct living space above the <br />detached garage. Motion was seconded by Campbell.
