Section 2. Section 10.12.010 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined): <br />Sec. 10.12.010. — Applicability. <br />This chapter shall apply whenever a bicycle is operated upon any street or <br />upon any public path set aside for the exclusive use of bicycles, subject to the <br />exceptions stated in this chapter. For the purposes of this chapter, the term <br />bicycle shall also include an electrical assisted bicycle, which is defined as a <br />vehicle having two (2) tandem wheels or two (2) parallel wheels and one (1) <br />forward wheel, fully operable pedals, an electric motor not exceeding seven <br />hundred fifty (750) watts of power and a top motor -powered speed of twenty (20) <br />miles per hour. <br />Section 3. The following sections and subsections in Title 14 of the Louisville <br />Municipal Code are hereby amended to read as follows (words added are underlined): <br />Sec. 14.08.050. — Electrical assisted bicycle. <br />Electrical assisted bicycle shall mean a vehicle having two (2) tandem <br />wheels or two (2) parallel wheels and one (1) forward wheel, fully operable <br />pedals, an electric motor not exceeding seven hundred fifty (750) watts of power <br />and a top motor -powered speed of twenty (20) miles per hour. <br />[existing Sections 14.08.050, 060 and 070 shall be renumbered as Sections <br />14.08.060, 070 and 080] <br />Sec. 14.12.010 — Compliance required. <br />I. Operate, drive, or ride upon any motorcycle, snowmobile, auto or other <br />motorized or nonmotorized vehicle in any park except when posted specifically <br />for such use; provided, that nonmotorized cycles and electrical assisted bicycles <br />shall be permitted to use pathways within any park unless such use is specifically <br />prohibited and signs are posted giving notice of such prohibition; <br />Section 4. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City <br />Council hereby declares that it would have passed this ordinance and each part hereof <br />irrespective of the fact that any one part be declared invalid. <br />Section 5. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />Ordinance No. 1736, Series 2017 <br />Page 2 of 3 <br />
