RESOLUTION NO. 27 <br />SERIES 2018 <br />A RESOLUTION AUTHORIZING THE TEMPORARY SUSPENSION OF <br />ENFORCEMENT OF PARTS OF SECTION 5.06.020 OF THE LOUISVILLE MUNICIPAL <br />CODE CONCERNING DOOR-TO-DOOR SOLICITATION <br />WHEREAS, by Ordinance No. 1461-2005 adopted December 6, 2005, the City Council <br />enacted Chapter 5.06 of the Louisville Municipal Code regarding the regulation of peddlers, <br />solicitors and vendors; and <br />WHEREAS, said regulations included a prohibition on door-to-door solicitation with <br />exemptions for certain types of activities as set forth in subsections A through D of Section <br />5.06.020 of the Louisville Municipal Code; and <br />WHEREAS, since the adoption of Ordinance No. 1461-2005, there have been <br />developments in the case law on door-to-door solicitation, including a recent decision in the <br />United States District Court for the District of Colorado enjoining a time restriction on door-to- <br />door solicitation enacted by the Town of Castle Rock; and <br />WHEREAS, in light of such developments, City Council desires to temporarily suspend <br />enforcement of subsections A through D of Section 5.06.020 of the Louisville Municipal Code in <br />order to give City Council time to consider possible amendments to Section 5.06.020; and <br />WHEREAS, City Council finds that the suspension of enforcement activities described <br />herein is in the best interests of the City and its citizens; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. There is hereby imposed a temporary suspension of the enforcement of <br />subsections A through D of Section 5.06.020 of the Louisville Municipal Code concerning door- <br />to-door solicitation. <br />2. The temporary suspension of subsections A through D of Section 5.06.020 of the <br />Louisville Municipal Code shall not affect the enforcement of any other provision of Chapter <br />5.06, including the prohibition against all solicitation when a "No Solicitation" sign or "No <br />Trespassing" sign is posted. <br />PASSED AND ADOPTED this 15th day of May, 018. <br />ATTEST: <br />Meredyth Muth, City Cle <br />Robert P.
