RESOLUTION NO. 31 <br />SERIES 2018 <br />A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF <br />LOUISVILLE AND PUBLIC SERVICE COMPANY OF COLORADO FOR THE <br />RELOCATION OF A TRANSMISSION POLE TO ACCOMMODATE THE <br />CONSTRUCTION OF THE STATE HIGHWAY 42 UNDERPASS <br />WHEREAS, the City plans to construct an underpass under State Highway 42 ("SH 42") <br />north of Hecla Drive as part of the City's joint undertaking with the Colorado Department of <br />Transportation to provide for the construction of improvements contributing to the safe flow of <br />vehicular and pedestrian traffic along State Highway 42; and <br />WHEREAS, the construction of the underpass will require the relocation of the Parkway <br />to Valmont 115kV electric transmission pole and line (the "Transmission Line") owned by <br />Public Service Company of Colorado ("PSCo"); and <br />WHEREAS, there has been proposed a Relocation Agreement between the City and <br />PSCo for the relocation of the Transmission Line to a location approximately ten feet north of its <br />current position; and <br />WHEREAS, the City Council desires to approve the Relocation Agreement; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE , COLORADO THAT: <br />1. The proposed Relocation Agreement ("Agreement") between the City of Louisville <br />and Public Service Company of Colorado for the relocation of the Parkway to Valmont 115kV <br />electric transmission pole and line to a location approximately ten feet north of its current <br />position is hereby approved in essentially the same form as the copy of such Agreement <br />accompanying this Resolution. <br />2. The Mayor is hereby authorized to execute the attached Agreement on behalf of the <br />City Council of the City of Louisville, except that the Mayor is hereby granted the authority to <br />negotiate and approve such revisions to said Agreement as the Mayor determines are necessary or <br />desirable for the protection of the City, so long as the essential terms and conditions of the <br />Agreement are not altered. <br />3. The City Council of the City of Louisville, Colorado hereby authorizes the <br />expenditure of funds necessary to meet the terms and obligations of the Agreement. <br />Resolution No. 31, Series 2018 <br />Page 1 of 2 <br />
