Figure 3: 363 Centennial Parkway Elevation <br />71711 <br />� VmIWlmlVMfn <br />di <br />lag "e ILL <br />1111.1IIIIIIW <br />ANALYSIS: <br />The proposal is subject to Chapter 17.42 (CMRS) and approval criteria in 17.40.010 <br />(SRUs) of the Louisville Municipal Code and the height waivers require compliance with <br />the waiver criteria in Sec. 17.28.110 (PUDs). <br />Compliance with LMC Chapter 17.42 — Telecommunications/CMRS Facilities <br />The application complies with all design and technical requirements of Chapter 17.42, <br />with the exception of the two height provisions discussed above. Staff finds the <br />application complies with the design requirements for roof mounted CMRS facilities, and <br />finds that the increased screened area accommodating the facility meets the <br />requirements in the LMC, including architectural compatibility for new screening <br />materials that are set back from the parapet edge. <br />Under general standards, facilities are to be designed to be compatible in color, texture, <br />and scale with surrounding buildings, and are to minimize adverse visual impacts. <br />Building mounted structures are encouraged over free standing or tower CMRS facilities <br />in the City. All facilities are required to meet applicable FCC regulations regarding <br />human health and exposure to radio frequency emissions. <br />Compliance with LMC Sec. 17.40.010 — Special Review Uses <br />Section 17.40.010 of the Louisville Municipal Code lists five criteria for SRUs that must <br />be satisfied in order to approve a SRU. Analysis of each criterion is below: <br />1. That the proposed use/development is consistent in all respects with the spirit <br />and intent of the comprehensive plan and of this chapter, and that it would not <br />be contrary to the general welfare and economic prosperity of the city or the <br />immediate neighborhood; <br />It is the intent of the provisions of Chapter 17.42 to provide a high level of <br />communication services to the residents of the City. The purpose of this <br />request is to accommodate the growth of the telecommunications industry in a <br />reasonable manner that is consistent with the community aesthetic and design <br />goals.
