RESOLUTION NO. 40 <br />SERIES 2018 <br />A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE NORTHERN <br />COLORADO WATER CONSERVANCY DISTRICT ACTING BY AND THROUGH ITS <br />SOUTHERN WATER SUPPLY PROJECT WATER ACTIVITY ENTERPRISE AND <br />THE CITY OF LOUISVILLE FOR CAPACITY IN THE E SOUTHERN WATER SUPPLY <br />PROJECT <br />WHEREAS, an Agreement for the allotment of the Capacity of the Southem Water Supply <br />Project, ("Agreement") has been proposed to further identify the City's future funding obligation for <br />the Southern Water Supply Project ("SWSP"); and <br />WHEREAS, the City Council desires to approve such Agreement and authorize its <br />execution. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The proposed Agreement for the allotment of the Capacity of the Southern Water <br />Supply Project ("Agreement") between the Northern Colorado Water Conservancy District, acting <br />by and through its Southern Water Supply Project Water Activity Enterprise and the City of <br />Louisville is hereby approved in essentially the same form as the copy of such Agreement <br />accompanying this Resolution. <br />2. The Mayor is authorized to execute such Agreement, except that the Mayor is <br />hereby granted the authority to negotiate and approve such revisions to said Agreement as the <br />Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the Agreement are not altered. <br />3. The Mayor, City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under such Agreement. <br />PASSED AND ADOPTED this 17th day of September. 2018. <br />1447 <br />Robert P.
