5 Review and discussion of rules and procedures. <br /> Sam Light, Griffiths and Tanoue- City Attorney, reviewed rules and procedures for the Board, <br /> stating as follows This board is a subordinate body of the City Council, you are also a public <br /> body There is a law in Colorado, called the open meetings law,which deals with open <br /> meetings for public entities and public bodies. I would just like to read some of these standards. <br /> First is that "Any meeting at which the adoption of any policy,position, resolutions, rule or <br /> formal action occurs, or is expected to occur, there must be full and timely notice of that <br /> meeting" That does not mean that everything that the board does is subject to a public hearing. <br /> It does mean that you do need to give the public notice of the fact that you are meeting. You are <br /> not necessarily required to take public comment on issues which come before you. I will remind <br /> the board what context they are working in. Second is "Meetings must be open and there must <br /> full and timely notice to the public. In addition to any other meeting of notice local public <br /> bodies shall be have been deemed to give notice if it post notice of it's meetings at least 24 <br /> hours in advance" I would therefore like to have a motion to designate as a place of posting for <br /> meetings of this body the glassed in bulletin board at the entrance to City Hall. Then as a <br /> convenience, if and when possible, also posting at the City Recreation Center and the City <br /> Library <br /> Said motion made and seconded. Motion passed by unanimous vote. <br /> Sam Light then stated. It is important to note that,for this body, when three or more of you <br /> get together to discuss any action or policy, rule or resolution, or any other action that you are <br /> going to take, or are considering taking, that would then be considered a meeting subject to <br /> the open meetings rules. <br /> There was discussion as follows <br /> Q Ray Schlott-Is the function of this board to render a yes or no decision, or can we work <br /> out some type of compromise? <br /> A. Sam Light-If a decision comes down from the building official you can either affirm, <br /> deny, or modify the decision. We will talk about the possibility of the Building Official <br /> working out a resolution even after the appeal is actually filed, but before the hearing is <br /> held. <br /> Q Ray Schlott-If there is an issue that is clear as far as the UBC code is concerned, can we <br /> then not modify that? <br /> A. Sam Light-No <br /> Q Greg Culhson-What would be the next level of appeal for a decision by this board. <br /> A. Sam Light- That would be an action in the district court. <br /> Q Greg Culhson- How many times could an appeal be resubmitted, and what would that be <br /> based on? <br /> 2 <br />
