A. Sam Light- We have built in the ability for one rehearing, only if there are new facts or if <br /> there is a mistake of fact, or if there was fraud or a clear misapprehension of the law, or <br /> there was a new law passed. <br /> Sam Light then addressed some of the provisions of the ordinance which created this board, <br /> stating as follows. The board is created to hear and decide appeals of orders and decision, or <br /> determinations,made by the building official relative to the application and interpretation of the <br /> building codes. Also included is to review any written final decision of the building official <br /> regarding suitability of matenals, methods of construction, or technical application and <br /> interpretation of the code. The board does not have the authority to interpret the <br /> administrative provisions of the code, or to waive and provisions of the code. <br /> There was discussion as follows. <br /> Q Ray Schlott- Will there be a format for all applicants presenting an appeal which they <br /> will need to follow Something like a check list. <br /> A. Tom Talboom-There really is not any kind of check list that you can create for a Board <br /> of Appeals. <br /> Q Check Keim - Would the board have the option to table a request in order to ask for some <br /> additional expert testimony? <br /> A. Yes. <br /> 5 Rules and Procedures <br /> The Board then went through the rules of procedure which were in the packets. Sam Light <br /> asked whether there were any comments or questions about the rules and procedures, or any <br /> suggestions or amendments. <br /> There was discussion as follows. <br /> Q Chuck Kiem-I am the associate member,which means I would not ordinarily vote <br /> unless someone is missing from the board. Should I then attend each meeting, or should I <br /> only attend when I am given notice that someone will be absent? <br /> A. Sam Light-The way the associate member works is that if there is a full board then it is <br /> at your discretion whether you want to come or not. From an administrative standpoint <br /> associate members are treated the same. They get the full packet, they get briefed as if <br /> they were going to participate in the hearing. <br /> Q If there are then five members present am I then mute? <br /> A. You are allowed to make comments but you are not allowed to vote. <br /> Tom Talboom-I think the associate member should attend all scheduled meetings the same as <br /> the regular members of the board. <br /> 3 <br />
