Staff Presentation - Tom Talboom requested that the following be enter into the record as <br /> exhibit A. The application for appeal. A letter to Tom Aten from The DAP Company technical <br /> center dated February 14, 1997 A letter from Tom Aten justifying his use of the product dated <br /> April 2, 1997 Copies of the labels from the can of the product Below Ground Wood <br /> Preservative. <br /> As exhibit B Summary of the case complied by himself as Building Official. A letter dated <br /> March 31 st which was sent to Tom Aten denying his request for use of the material as an <br /> alternative to sections 2302.1, 2303 1 and section 2317 11,which deal with pressure treated <br /> wood. Copies of the applicable code sections, including section 104.2.8 which is the authority of <br /> the Building Official under alternate methods and materials to allow an alternate material <br /> providing it is a satisfactory equivalent. Pages from the code book from sections 2303 which <br /> defines treated wood. Section 2303, general requirements, which list the standards for pressure <br /> treatment process and quality control. Section 2317, decay and termite protection, dealing with <br /> pressure treated wood and its application as an approved material. Also included are two sample <br /> evaluation reports produced by the three major code agency's, I.C.B 0 , B 0 C.A. and Southern <br /> Building Code International showing the typical listings of pressure treated products. Next are <br /> copies of three inspections sheets for inspections performed at 530 Fairfield Lane noting that the <br /> window wells needed to be of treated wood. One dated 10/10/96, one dated 1/14/97 and one date <br /> 1/16/97 <br /> Giles Schurman-The exhibits have been marked for identification as exhibit"A" and exhibit <br /> "B" Does any person have any objections to the admission of exhibit"A" or exhibit`B" <br /> Heanng no objection exhibit"A" and exhibit"B"are admitted. <br /> Taking of oath <br /> Christopher Greenwald- Would Mr Aten and Mr Talboom both please stand and raise your <br /> right hand. You have before you the appeals case B97-001 The <br /> applicant is Tom Aten of Westwood Homes Inc. Mr Aten is requesting relief from the Uniform <br /> Building Code requirements for the minimum standards for wood being used below grade, <br /> specifically for retaining dirt or ground at windows. The material he is using is a 2 X 10 hem fir, <br /> which he treated with a product called DAP below ground wood life. Specifically, sections <br /> 2302 1 and 2303 1 deal with the preservative requirements for wood being used below ground. <br /> 2 <br />
