durability and longevity of the product. I feel that the window wells that I installed, and treated
with three coats of the underground wood product, are superior to either of these products which
have been accepted in the past by the City of Louisville. I also did the stair step window wells to
provide a superior product for people to use. I was very surprised to find the gentleman from
DAP stated that they should be retreated every few years in order to have the equivalence of
pressure treated lumber Mr Talboom has stated that the outside materials are to meet the same
criteria as the house itself I strive to build the best home which I possible can. I cannot image
any homeowner who would expect a deck, or exterior window wells,to be in tact in 100 years.
Therefore I do not feel that exterior applications fall under the same criteria as the nuts, bolts and
structure of a home.
In summation I feel that my product provides a far superior egress system out of the basement. I
think it is very questionable as to how long any product will last in the ground. I am in a
situation which will make it difficult to dig out the window wells as they are between existing
homes.
Giles Schurman. Exhibit"C" is submitted into the record. That being the informational pages
provided by Mr Aten.
Questions to Applicant
Q Giles Schurman- The label for the DAP product indicates that it is for use on fence posts
and posts. Is that not contrary to your use on 2 X 10 lumber? Do you feel like your use
is in conformity of the product?
A. Tom Aten-I was very dissatisfied with the twisting and cracking of pressure treated
lumber I wanted to give the customer a better product. I went to the local lumber yard
and was told that this was the proper product to put on. I understand that does not make
it correct. That is the reason I choose this product, because it was recommended by BMC
lumber
Q Giles Schurman-Do you feel that the lumber yard personnel understand the Uniform
Building Code requirements for below grade lumber?
A. Tom Aten-At this point, no I am not proposing to construct future window wells out of
this product.
Q Robert Spencer- You built the window wells and then applied the three coats of the
product?
A. Tom Aten- Yes,before the backfilling for the foundation.
Q Robert Spencer-If they were constructed prior to treatment, how did the inch and a half
edge get treated?
A. Tom Aten-I could only treat the edges which were exposed.
Q Robert Spencer- So with drying and shrinking, through time, we then have part of an
application that is not treated, correct?
A. Tom Aten-That is correct.
5
