A. Tom Aten-Approximately 100 to 120 square feet. <br /> Q Giles Schurman- Why did you used this product on something other than fence post and <br /> poles? <br /> A. Tom Aten-This is the product which was recommended by BMC West. The letter from <br /> DAP also indicates that the product is suitable for the use described, mainly around <br /> window wells. I felt that the documentation from DAP would support the use of this as <br /> an acceptable equivalent. <br /> Q Greg Cullison- You were first notified of non-compliance on the inspection report dated <br /> 10/10, why did you not address the problem at that point? <br /> A. Tom Aten- The framing inspection would not have been approved without all other <br /> items on that list being corrected. This was a separate issue which I felt would be solved <br /> by a letter from the DAP company <br /> Q Greg Cullison-Was there any reference from the building inspector during the <br /> inspections through to the final that this needed to be dealt with? <br /> A. Tom Aten- This was definitely not an item that required immediate attention. The whole <br /> idea was to give me time to produce the documentation. <br /> Q Greg Cullison- So you started working to get the information together on 10/10/96? <br /> A. Tom Aten-I would say, realistically, that it was probably a month later than I started <br /> writing letters. <br /> Q Greg Cullison- So you made no effort to contact Mr Talboom and discuss the matter <br /> with him. <br /> A. Tom Aten-I believe Mr Talboom was aware that I was pursuing those ends. <br /> A. Tom Talboom-I presumed that Mr Aten was attempting to get the required <br /> documentation. My first contact with Mr Aten was in October of 96 and again when it <br /> came time for the Certificate of Occupancy <br /> Q Ray Schlott-In exhibit B the next inspection report after the 10/10 report is dated <br /> 1/14/97, is that the next inspection. <br /> A. Tom Aten- Yes. <br /> Q Ray Schlott- So that is when all of items on the 10/10 inspection report were corrected? <br /> A. Tom Aten-No All the items, with the exception of the window wells, were corrected in <br /> order to proceed to the insulation inspection. <br /> Q Ray Schlott-Why did you not soak the wood in the DAP product as is indicated on the <br /> label for ground contact use? <br /> A. Tom Aten- The directions state that in the event that you are not able to soak it, 2 liberal <br /> applications with a brush are acceptable. <br /> Q Erik Hartronft to Tom Talboom- On the inspection report dated 1/16 the note reads <br /> "window wells need to be treated wood or natural resistance to decay" , is this saying that <br /> the inspector would have allowed Mr Aten to construct these of redwood? <br /> A. Tom Talboom- I am not sure why the inspector wrote that, when all the others stated <br /> treated wood. That inspector was at the initial contact with Mr Aten an knew that is <br /> should be treated wood. Wood with resistance to decay does not meet the code <br /> A. Tom Aten-It was my understanding that redwood was an equivalent product to pressure <br /> treated wood. I think that this whole discussion has been about equivalent. I have not <br /> 7 <br />
